The Appointment of Judges

The Prime Minister has announced that judges would be chosen by a Commission specially set up for this purpose.

2. No details have been made public as to the way the Commission would work.

3. Would the Commission actually appoint the judges or would it only recommend the names for the PM to approve or would the Commission recommend directly to the Agong for him to exercise his prerogative? Or would the Agong require the approval of the Rulers Conference? Or would the Conference of Rulers be merely consulted as is done now? Or would they be able to reject the candidate, and ask for new candidates or name new candidates of their choice?

4. It would be interesting to know the full details of the procedures, above all with regard to the role of the PM.

5. The appointment of judges is provided for in the Constitution. If changes are to be made in any way, they must be considered as in breach of the Constitution.

6. To make the changes legal, the Constitution has to be changed.

7. As everyone knows changes in the Constitution can only be made if two-thirds of the members of Parliament in session agreed with the proposed changes.

8. The Government does not have the necessary two-thirds majority. By itself it will not be able to change the manner with which the judges are chosen. It can only do so if the opposition supports it by at least nine votes.

9. Is the Government proposing to work with the opposition on this issue, and so display its weakness? Will there be a quid pro quo, a bargain with the opposition? It would be interesting to see how the PM proposes to deal with this.

Tun,
The problem is that you were the PM of this country for too long. You cannot live without showing your authority, directly or indirectly. You don't know how to leave graciously.

The thought of people have changed. The MPs are representative of the people. There is nothing wrong for the ruling party to work with opposition if that makes sense. You need to have a high self-esteem to be able to work with opposition. Please change your thinking, it is outdated.

Anyway, all this mess related to Malaysian Judiciary is caused by you. You were a dictator, and opportunist and self-centered.

The late Tunku said 'Mahathir would destroy UMNO if he comes to power.' He was right. You destroyed UMNO, you killed the UMNO because of your power greed. The current UMNO is not the same UMNO. The country is in a mess now. The Malays are in mess now. Malays don't know what Malay Special rights means, you have created a mind set that Malays don't need to work hard like the rest, but they can qualify for university, get better jobs, get promotion, buy houses at cheaper price (although not handicapped), etc, etc, etc.

Assallammuallaikum Tun,

Since your resignation as the PM, the word PM leaves a very bad outh. The current PM is nothing compared to your good self. Attributes of current PM - tertidor sini terlena sana, indecisive and I think everybody knows it. May Allah helps Malaysia under the current PM. Always giving perks to the civil servive to garner votes (doesn't it smell of money politicks). Don't get me wrong, I am not against the civil service but the lack of discretion in giving handouts for votes. Semoga Allah lanjutkan usia Tun. Wassalam

Tahniah Tun kerana membuka tirai melalui blog Tun sendiri. Tetapi kini, bilangan orang melayu berniaga meningkat begitu ramai.

Dearest Tun,

I just wanted to say that I am proud to have had a PM like you and may God bless you and your family.

The current BN government under AAB is crap and I am one of those who have now supported the opposition instead. I am sorry to say this but the current government has demonstrated to us that they no longer serve the people but instead do it for their own political well-being.

Like it or not, the opposition now has a stronger voice. Unless BN works with them for the betterment of all Malaysians, I do not see how BN is going to stay relevant for the next decade or so.

Dear Che Det,

Welcome to the Tsunami aftermath. Firstly, I wish you good health. I am of the opinion that the Government should actively start fostering 'working relationships' with the opposition for the greater good of Malaysia and her people.

It has to be remembered that both Ruling and Opposition teams are here today to ensure that justice is done (and seen to be done too). We have witnessed the Darkest Hour of our Judiciary and it is high time that the 'tennis match' of blame throwing ended and progressive solutions to reinstating the supremacy of the Judicuary be actively pursued.

Malaysia must remain sovereign and equiutable long after you, Pak Lah and DSAI have perished and the only thing that will be left standing is the Constitution by which everything else will draw its breath from.

I believe that the darkness is slowly lifting. It isn't important who forms the government of the day but only that the people who seek shelter in this glorious land are treated fairly and without prejudice and paranoia.

While you have had the opportunity to make something of this country and, no doubt you've had a great share of success (for which I am so grateful) but the dirt swept under the carpet has to be vaccummed. Skeletons hidden in the closet have to be buried and I am sure that is what the general Malaysian is expecting to see.

Welcome once again, Dear Sir and I pray that you would be a cornerstone in rebuilding this ailing nation for her good and the good of all her children.

Best wishes,
Mikester

I'm sure everyone know there has been so many protests in PJ and KL area, but what happen at the end?protestors get arrested and bash by police.i just cannot understand why the police culture in M'sia is to bully those poor citizen instead of protecting them.... I really like to know the answer of this! Once again thanks for creating this blog and thanks for leading M'sia for the pass 23 years, proud to be Malaysian under your leadership.Do take care.

I don't see anything wrong with the justice system in Malaysia except that it was missused by certain quarters to benefit themselve just like in any other country in any other part of the world today. To change the system now by forming a new commission in the appointment of judges and blame it on the past rulers is wrong and not make any sense and looks very bad on our judges. Like you say Tun, the appointment of judges is still subjective to the PM final dicision which make the newly appointed judges as suspicious as earlier judges that were tarnished their images purposely by someone now elected YB. If now Malaysia is building its justice system on such a foundation then the other system it is building to uphold democratic system is a joke just like the "bozos" in Parliment. I wonder where Pak Lah is heading. I am worried about the Malay and Islam in Malaysia now as we totally depand on the govenment to protect our interest. We never voiced out but if need be the entire system will be out of hand especially now that our right and religion are clearly being challenged.

I have watch so many Paliment sitting on TV news BUT the one on the 30th April 2008 is undiscrible. It was a mokery. Even a kindigarden children behave so much better than these bunch of MONKEYS!!!!!!..Ops, I feel monkeys behave much better than them especially the Opposition leaders. A real shame. Calling themself a socall elected MP's who represent the people who voted for them.
People of Malaysia, we now need not go to Taman Melawati to go to the ZOO. There is one in the heart of KL - our new ZOO:- the Paliment House. Only diferent one need to dress in proper atire but soon you all need not, just wear shots and T shirt will do.
What is happening to the counrty, been run by a bunch of uncivilized creatures. Will not mention the world 'human' as many of us are very human and behave like human NOT like these elected baberians. Names will not be mentioned as they are so good in suing you if you say bad of them. They say we so call slander them and their reputation. They themself should who I am mentioning.

It's always easy to criticise and take pot shot at single items but being a leader is a different thing altogether.

You've done a great job. But like the old Malacca Empire, a weak leader can cause the downfall of the Golden Age and we lost our country, our heritage and our pride for 446 years. I can't bear to think that the same fate might fall to my children and their children after. Not just we just earn our place in this world. Dear Tun,
What say you to the following questions on the Judicial Appointment Commission?

1. Can the Commission ensure that the Judges appointed using this new process be free of corruption and other malpractices?
2. Will there be any quota according to the racial composition of the country?
3. Will the appointment be made purely based on merits?
4. Will the Commission make recommendations for appointment from amongst the practising lawyers only or will it be responsible for all appointments including from the Government service and non-practising lawyers as in the case of law lecturers etc.
5. What will happen if in the event the Prime Minister did not follow the recommendation of the Commission but instead named a person of his own choice in accordance with the provision of the Federal Constitution as it stand unamended?
6. Or, will the Constitution be amended to compel the Prime Minister to accept in toto the recommendations made by the Commission?
7. Can the Commission ensure the elimination or the absence of the element of lobbying for the Judgeship?

According to Zaid Ibrahim in the RTM Bersama Menteri programme few nights ago, the Commission's composition and terms of reference had yet to be finalised. Why then was the announcement made and made at a dinner hosted by the Bar Council in the presence of Opposition leaders & detractors to the Government?

Although i do admire the way you think, there is this feeling (and I am not alone in this) that somehow, most of our country's problems were caused by you.

However hard your supporters will try to twist and deny this, most Malaysians now will concede that in the 22 years you were in power was when corruption, cronyism, disintegration of the judiciary, etc, etc, first saw the light of day.

At 82, it is time for you to correct what was wrong and do what you can to put things right.

Good Day Sir,

First of all i would like to thanks you for the great work you have done for our country in the past, made us proud to be Malaysians and further more putting Malaysia on the world map.

I personally think you are a remarkable leader, keeping our country at bay with whatever means and still manage to build the country according to your vision. Malaysia is a multi racial country with all kinds of diversity hence the difference of opinions is always there. You have always handled the situations and have made Malaysia peaceful.

There are many things that could have been done differently during your time as our leader, some for the better and some for the worse, but i believe your decisions then and now have been thought through with full understanding of repercussions and full understanding of the consequences before actually following through with. Making it a decision with reason.

I just wanted to show my full appreciation to your good-self and to let you know i truly appreciate all you have done for this beautiful country. Thanks for being our leader for so many years, thanks for being my leader.

Cheers and god bless.

Tun,
nowdays food is more important than industrial, how to overcome this problem?

Tun,
I'm respecting u because you can be prime minister for 22 years. For me it's hard to be prime minister in Malaysia. There are many ethnics in Malaysia. So it is very difficult to control and fulfill;cultures and needs.

Tun,
May God bless u.hopefully more post by u.bye.

Assalamualaikum Tun

DearTun,

Welcome to the blogging fraternity, Sir.

When Rocky mentioned that blogging will never be the same again, it is for a number of reasons, such as -

a) How many bloggers can describe themselves as 'Prime Minister of Malaysia 1981-2003' in their 'About me' page?

b) 650 comments within 24 hours.

c) Over 65,000 hits within the same period.

Unwittingly, you have raised the benchmark, yet again.

Now I'm wondering if Rocky will appoint you as Mentor Blogger in All-Blogs.

Wonders never ceases and I thank you for joining us.

Dear Sir,
You have mentioned some noteworthy points.
However, I do take offense to the below ......

9. Is the Government proposing to work with the opposition on this issue, and so display its weakness? Will there be a quid pro quo, a bargain with the opposition? It would be interesting to see how the PM proposes to deal with this.
===================

TDM Sir,

It beats be, how you have come to the conclusion, that to work with the people's choice/mandate, "is a sign of weakness".

I see it quite differently, Tun Sir - I believe that it is a sign of weakness and insecurity, that you cannot see your perceived "opponents" as equal partners in nation building, by casting aside partisan politics in the interest of the rakyat.

The problem herein, isn't the fact that they are "opposition", but in the perverted perception that they are adversaries.

This perception comes about in one, thru a few mechanisms (possibly more than what's below) :-

a). One is arrogant and egoistic.
b). One suffers from a deep-seated or subconscious inferiority complex and insecurity, that gives rise to this seige mentality of "flight or fight" (that uses the mid-brain, rather than the grey matter).
c). One subscribes to authoritorian/ dictatorship rule only, perpetuated by fear mongering (thru the 'nurtured sense of fear, insecurity and inferiority-complex' in the people)

I'd choose to believe that you might fit better into category (c).
What you seem to advocate, appears to be the idea that, for a govt to be strong, it has to have that magical 2/3 majority.
That however, is only true in a case where the representatives in the parliament serves the President of the party and toes the party line (right or wrong), and not the people who put them in office.

This idea is so "primitively 3rd-world" as far as I'm concerned - and it is not what the parliamentary democracy is all about.

It is the idea of govt, that the UMNO/ UMNO Baru (vis-a-vis Alliance/ BN parties) have successfully implemented/enforced thus far, to perpetuate their hegemony.
It is also what is spun out as the virtuous "Asian Values" that you every so often preach.

It thrives on the condescending idea/ premise, that the unthinking rakyat don't know anything, and that you do.

Time to call a spade a spade Tun - and it's running short, real fast!

The way you write, makes it sound as if all was fine and sound during your tenure. The judicial crisis took place during your rather 'despotic' helm at power. I believe Pak Lah should be given a chance, and your rantings distorts his eforts. You have been given more than twenty years to prove yourself, and all we saw was sheer corruption and widespread nepotism. Yes, it is still a malaise in Pak Lah's years, but he is taking efforts to combat it now.
Almost all draconian laws were passes during your years. You amended the constitution endlessly, till it is something so alien at present. The ISA came into effect, and you proudly boasted that it was your brainchild. As the Malay saying goes, "Mengata orang, dia yang lebih".

P.S Ido not intend to hurt anyone's feelings, but i was merely expressing what i felt. Thank you

As'kum,

Apa khabar Tun? Saya menghormati Tun seperti Allahyarham P.Ramlee. Cannot and not easy and waiting for the million is very hard. Tapi mereka lupa jasa Tun sehingga Malaysia dikenali Didunia. Dulu mereka siap nangis kerana Tun meletak jawatan.

Sekian Terima Kasih.

The iconic drivers that you have developed and put in during your terms must be maintained and protected. Like F1, KLIA, TwinTower, MSC, Menara Tower, Bridges and Highways, Langkawi, etc. They were all really icons of a progressive Malaysia.

We need you to be active, this will certainly make the BN and PR more pro-active, pro-people, sensitive and action-oriented on the needs of the general public.

Please look into the effectiveness and efficiencies of government offices in rendering services to the general public.

I could account for the massive differences that you have done and compared with the current leadership for the same period of time.

More power to you and god bless you and your family.

My late father and i were huge fans of you. Even during the Anwar-sacked years, when a pea sized brain could tell that there must be some kind of involvment on your part on the charges. etc. we refused to yield when those around us pointed out the obvious facts against you.

But now, you have really gone too far. It's good you have a blog but I think I won't be too excited to read your comments. Why? Because simply there is not much common sense that i can see in your rhetoric so far. Ah common sense, something which is not so common nowadays. You sound more of a lover jilted than an ex-pm giving constructive criticism. Your mouth is way, way ahead than your ass that it cannot catch up now.

i don't know what my late father will think of you if he were still alive. but i'll let you know about one of his favourite phrases:
You know, God know but i don't know. Meaning Tun, I have no idea what you are up to Tun, only you know it and God. May He has mercy on all of us.

Why Did You Recommend That Yg Arif Abbas Be sacked, Che Det?
(the agung is the one who sacked him, wasn't he?)

You said on a brits TV show that this is a political move by the PM. Now, what does the PM has to gain and what do the people have to lose if the move is engineered in the best way possible for the maximum benefit of the country? Anyway, when is the new appointments of new top judges?

The good thing is that the BPR is also being tinkered at at the same time - a more independent BPR.

What about the AG chamber? Do you think that the AG Chamber should also be more independent, Che Det?
(seems that sometimes in old, old cases there are not many witnesses left to court the judges to rule in favor of the truth and justice, for example is the stainless Eric Chan case)

Do you think in times of economic uncertainties this - the judiciary reinvention? - is a good political exercise, Che Det.

PEACE!

Assalamualaikum,

The eagle has finally landed *smile*.

Its good to hear from you again. I know you have been doing some talks in quite a number of forums lately but unfortunately time didnt permit me to attend any of if.

Che Det,
To most of us, you are the greatest leader (if not among the best) the world has ever seen. I'm proud in our history (or in my lifetime) I have known such monumental figure in leadership.

Che Det,
I understand, it was not an easy task being a PM. A PM can be anybody but not everybody can be a PM. Only a true leader can lead a country. Having said that, I thank you for leading Malaysia for 22 years.

To err is human. Even a great leader like you made mistakes. But I'd like view it in a positive perspective. Without mistakes we can never learn. It is very sad when some people are obsessed with what you did wrong in the past and trying bring down your reputation.

Che Det,
I know you worked hard to change the mindset of the malays. In my humble opinion, the ideas and policies that you have implemented to improve the malays are very good. You have repeatedly said about one day the tongkat (malay rights) that support the malays will one day gone. But no one are really listening. You gave some malay entrepreneurs chances to be successful and yet most of them forgot to return the favour. Melayu Mudah Lupa should be changed to Melayu Memang Pelupa. I see this type of malay everywhere. Be it in government, politics or business. To say you didnt help malay to stand on its own is definitely inaccurate.

To forgive is divine. I think everybody should forgive each other and move on to build a better Malaysia. This is country is not for us but for our children and many generations to come.

Please don't stop with what you are doing now cos to me, you are the only one who can save the rakyat. No one else can or will help us.

Please think of the ways to get Pak Lah 'susah turun' to relinguish his undeserved position. He's destroying whatever left of our bangsa tercinta & also also our religion. He's a disgrace.

Since he's in power (or so he thought), everything 'susah nak turun'... petrol, makanan asas, tol, beras (!!!!) dan dia sendiri.

You are what a leader should be. Hidup Tun Dr Mahathir !!!

A bit of a joke, this blog of yours, eh? All these butt-kissers praising you to the heavens must be from some other world, 'cos in the real Malaysia where I live, out of 100 people I meet, at least 70 would be very negative in their appraisal of your performance as PM. The other 30% would still see you as flawed though they favour you overall.

So you see, even in this blog world you are surrounded by syncopants. Your downfall is not that you have them around you, but that you believe they are right.

Frankly speaking, we need leader like you (Dr M) to bring Malaysia forward... For the past eight years, we are stepping on the same ground, not much progress... In some area, we can even see going backward...

It is sad to hear the PM say the reason there are more corruption case now is because the government is very transparent in reporting such incidences. Therefore statistically the number should increase.. Who he want to fool? the Rakyat or himself?

You're the person that I respect most since I was a kid,
I still remember at the age of 7 watching you every night in front of the television during the News at 8,
for every controversies, you managed to handle it the best,
how my mother keep on repeating to myself that how such a great person you are.

Tun, I hope you are going to write a book especially made to inspire our new born-generation to reach glory. I'm quite sad of seeing how day by day,our new generation seems to forget their duties towards bangsa, agama & negara.

You're irreplaceable, you're a great Khalifah.

Dear Tun,

Thank you for being part of the blogsphere. I do not see why the ruling party cannot co-operate with the opposition on such grave matters such as the setting up the commission.
After all it's for the interest of all citizens in Malaysia. It also puzzles me when you were the PM and had so much control of the government, why didn't you initiate changes then?
We, the people had given you the mandate to make changes for the wellbeing of the country not just physical developments such as the mega projects that we have now. How about corruption, bribery and other social ills in the government sector?
I guess your time has come to let others deliver the changes that will surely take place in the near furture.
Thank you for all your past contributions to our beloved country but for now put aside all the differences and be on the side of the people who still have high regards for you, my dear Tun Dr.Mahathir.

Hi there, I was waiting for this opportunity to feed back to you on your good self for a long time. If I made these statements during your tenure as PM, I might have made myself a resident in Kamuting detention camp. I was very glad that you are bombarded massively in Hard Talk. I always believe people like you make mistake by appearing in that talk show. Nevertheless, I think it is not your courage that made you to appear in that talk show but rather you were pushed to the edge to act dumb.

Let me tell you, your successes are not really measurable to what you thought. I believe the DAP; lim kit siang could have brought Malaysia into a better prosperous country over the last 22 years. I have argued with many Malaysian who thinks that you have brought this country into the heights of developing country. The only thing that I believe that you might have made the difference is Proton. That bloody car; I had problem for the years I drove in it. Because of you, I could not own a comfort Japanese car which 200% reliable and comfort than Proton.

The most wanted topic I want to highlight is your hypocrisy in religion. I believe you have made Islam into ‘Mahathir Islam’ with your obliviously decorated version of Islam. You have propaganda of making the Malays into Islamisation. The years before yours saw Malays leading a more developed lifestyle. They were open social people with no barriers. Today because of you, your JAIS department and other fanatical departments made Islam into a joke. Today the version of Islam in Malaysia is a joke. It is far cry then the actual practiced Islam before mid 80’s. I think the non Muslim would have loved that version of Islam which was ‘open to believe’. Today, because of your policies it is ‘forced to believe’. Don’t you think that you are a fanatical person? You were arguing about freedom and justice for the Palestine while in Malaysia you were not only irresponsible PM to the non Malays but created a monstrous system. Today that system is eating you up. Your words were actually a ‘double sword’. Now it has turned against you. ‘Melayu mudah lupa’ has turned out to be ‘Mahathir mudah lupa’. I believe you have spoilt the Islam view to foreigners even from Arab nation. I am amazed to see a scarf Arab lady drinking alcohol here. I believe even they are living freely and enjoying their life than us!

You were one lousiest individual that I have read about, lived with and I hope that I should be free of you soon. You are very lucky that I have to keep my comments clean and short.

Tun pernah tulis "Malay delima" empat puluh tahun dulu. Bolehkah Tun tulis "Malay delima - revisited" cerita sikit jatuh bangun bangsa melayu.

Das kapita, art of war, 7 military clasic, books of five rings, La tahzan, The Kemp, Sejarah Melayu, Malay delima, My story...

Hello Tun,

Semoga panjang umur. May God Bless you and your family.

Assalamualaikum Tun berdua.

paling saya tak boleh lupa..

@ press conference NAM atau OIC
(maaf Tun, tak ingat..) di KL, seorang female journalist (foreigner rasanya) popped up
a question - (lebih kurang) "What do you have to say that now your Petronas Twin Towers is no longer
the tallest building in the world?"

Tun jawab tanpa teragak2 langsung - "they have only one, we have two!!!"

Semua yg berada di bilik PC tu berderai ketawa. Female journalist tu tak terkata apa, hanya menggelengkan kepala sambil tersenyum..

Tun, only you so far who can do that beautifully.. your mind acts faster than your words. thats why we adore you, no doubt about that.

rasa-rasa macam mana ya na dapat sedikit cebisan drp akal dan minda yg inevitably distinguished tu...

give us some tips, Tun.
TQ, salam...

Sudahlah rakyat tak sokong dia, dia terus tak malu jadi PM. Suruh dia duduk kedai kopi dimana-mana, baru dia tau pendapat rakyat tentang dia. Kalau sekadar cakap saja, budak sekolah pun boleh. Betul cakap Tun, orang UMNO ni, bila dah hilang kuasa memerintah baru sedar. Mungkin Nazri layak.

Jangan tunggu Pak Lah terus tidur, bangun tengok, orang lain pegang negeri. Orang Melayu perlu pemimpin baru agar maruah mereka tidak tergadai.

Dear Dr Mahatir
I am a Singapore citizen and have money and shares in Malaysia. I want to thank you. In 1997, when the speculators want to 'kill' everybody, you are the only person who saves everybody. Do you know that a lot of people including me cheered (and very happy) when you impose capital control. When the IMF and so on wants everybody to increase interest rates, you stopped them. Why are they now reducing interest rates in their own countries? The only answer I can give is 'they are real hypocrits. You demonstrate, they cheered. That is all they do. These are real lousy people.' Now the world has changed for the better (a little bit only) because their money is going down. I predict this is the beginning of their downfall. After you are gone, touch wood, they will know you are a great man and incomparable.
I thank you again for saving me and a lot of people from going bankrupt in 1997.
May I wish you good health.

however, Malaysia is still a "mind divided" country after 50 years, nothing has been changed during your reign.

i still believe people's interest is most important in a country, working with opposition parties is not a sign of weakness, politics is to bring order, justice, and prosperity to people!

if the people get benefits from this action, why we should oppose it?

Prerogative of the King is not really understood by the masses. I believe, with the level of academic qualification possessed by the royals now, as well as public job or positioned held prior to their appointment as Sultan/Raja, time for their active roles and clear decisions had arrived. But such development may require unprecedeneted constitutional amendment in the future and total change in our beloved country. Syabas Tun for blogging.
