The Appointment of Judges

The Prime Minister has announced that judges would be chosen by a Commission specially set up for this purpose.

2. No details have been made public as to the way the Commission would work.

3. Would the Commission actually appoint the judges or would it only recommend the names for the PM to approve or would the Commission recommend directly to the Agong for him to exercise his prerogative? Or would the Agong require the approval of the Rulers Conference? Or would the Conference of Rulers be merely consulted as is done now? Or would they be able to reject the candidate, and ask for new candidates or name new candidates of their choice?

4. It would be interesting to know the full details of the procedures, above all with regard to the role of the PM.

5. The appointment of judges is provided for in the Constitution. If changes are to be made in any way, they must be considered as in breach of the Constitution.

6. To make the changes legal, the Constitution has to be changed.

7. As everyone knows changes in the Constitution can only be made if two-thirds of the members of Parliament in session agreed with the proposed changes.

8. The Government does not have the necessary two-thirds majority. By itself it will not be able to change the manner with which the judges are chosen. It can only do so if the opposition supports it by at least nine votes.

9. Is the Government proposing to work with the opposition on this issue, and so display its weakness? Will there be a quid pro quo, a bargain with the opposition? It would be interesting to see how the PM proposes to deal with this.

Welcome to my world Tun! I've been here since almost the begining. And I have set the rules of engagement to which I try very hard to abide by. And that simply means no rules. First instincts are what I try to capture and that is what you shall get from me. As far as is possible..the honest truth.

Now as for your question:

Tun, I would like to suggest the very opposite. When you are right on an issue and you are confident enough, you will engage the "enemy" to work with you.

Obviously, UMNO and you as the head of it have ooperated on the assumption that there can be nothing good that can be intended of the "opposition". Indeed in Malaysia, and worse still Singapore, alone you find that the "position" or anyone seen to be operating in the same political arena where you don't hold the puppet strings, you make it a point to demonise.

But why I used to wonder. Why did you not, if they were indeed so demonic, and always working against the interest of the country and the nation, with your twothirds majority just cange the constitution so that all opposition can be done away with at anytime. In a Malaysia Boelh environment and where democracy is as is defined by you, you could have achieved it and the people would have just accepted it.

Of course you would be accused of being a dictator,which you aleady were even without haivng banned the "opposition".

My only answer to this that I have found reasonable is that a dictator in that realm will be found out of place dressing in Armani suits going into fancy places.

Aside from that, sir, other than maybe, your question
being particularly a little too clever by half, I think its rather sinister in that it does not exactly address itself to most of us. It seems designed to irk the Malays to look at this possibility as a sign of weakness that UMNO which has only known how to operate from a "ketuanan" stand point has now got to come down to the opposition who, without being subservient to them, independently decide or barter over how this is going to go.

This having to have to parlay with "the others" or as you very cleverly cultivated, "opposition" = "non-Malays/Chinese" + non-Muslims + Anwar Ibrahim, certainly for once would see UMNO treading into uncharted waters.

But, tell me sir, we are all Malaysians. We all love this country. We all want to do good for this country and see it prosper and the people all prosper along with it. So what is so wrong with UMNO stepping down a couple of nothches so that the people can advance. It is the people who are relevant. Not UMNO sir.

Sir, I am grateful that you finally started your own blog. I very appreciated of what you done to Malaysia. In addition as what amlg said, Semoga Allah terus memberkati akal dan fizikal Tun untuk terus menyumbang kepada negara.


From 2004, it is clearly that the Malaysia is slowly transforming to Indonesia because IT IS full of CRIMES.

Use Monorail for first time in 2008 because my friend from United Kingdom said he wanted to try it, then already got pick pocketed mobile phone and wallet, not to mention there is no security in the station during the midnight.

I still remember, when my mom I/C and bag got stolen after going out from bank, the police just ask my mom to report lost instead of stolen or they threaten my mom that she need to go to Bukit aman and the origin police station everyday. Not to mention, it is our first time that our family met thief.

Yes, BN has opened nice complain website and even the Police ask me to clarify the matter, but after the elections, all the email has been totally ignored by them.

The above statement is not complaining about anything, but only to expressed the leader difference between the "Saya Pantang dicabar" and Dr.Mahathir.

I hope that you can heal the BN from going down to the river.

You were, for 22 years, the dynamic, visionary, firm (some called you recalcitrant for this),dedicated leader and Prime Minister of Malaysia. During your tenure, not all of the policies and decisions that you have made is agreeable with me, as a citizen of Malaysia. However, I thanked God that you were there when our country needs you most.

This humble Malaysian hopes that you will again rise to be the Sentinel of this country. Only now, the culprit/s is from within.

Therefore, your voice needs to heard again. Your continous comments, especially now that you have your own blog, will give all Malaysians a broader perspective of events happening today in our country.

Your comments and crticism on the decision made by our current PM (just don't know whether he is awake when he made that statement), is most appropriate except your pargraph which is skewed towards party line.

Thank you for being there when Malaysia needs you and NOW, Malaysia needs you again, not as a Prime Minister, but as an Elder Statesman whose comments and criticisms is most needed.

I used to be a fan of yours.

But then, I grew up.

Regardless, I've always considered you to be a person of class. Until you destroyed the judicial system and the credibility of a man that should not have got what he deserved.

I welcome the creation of your blog, but this just shows that you have become desperate to have to resort to this medium, after the mainstream media shunned you, the media which you yourself ruled and had total control during your tenure.

With all due respect, what goes around, comes around, good Sir.

You left us with a weak PM. And now you say that your original choice is not good enough.

You left us with rich greedy corporate hogs, that stopped the buck at the top, instead of letting it trickle down to us common-people. Your intentions, while well-meaning, weren't followed through. That's just as good as dead. Might as well don't have such economic policies. Still means the same to us commoners.

We wish for your well being, for your health and for your happiness with your family. We wish for you to remember god at this time. Politics is a dirty, dirty game. I cannot imagine the amount of ablution it would take to clean that dirt up.

Yes, I pass judgment. I am guilty. But it comes with the territory, Sir.

I don't know what legacy you'll leave my grandchildren 50 years down the road.

Did he leave office too soon? Did he destroy Malaysiana? Did he right the wrongs? Did he break down walls or build bridges?

You're too proud to admit that you've done mistakes. But it takes a real leader/man/person-of-generations to admit the wrongs and try to correct it.

Tun, what is your say against this govt who allows such a bad reputation company to invest in our land. Is the govt so desperate for foreign investment or the silent relationship the present PM has with Bush? I am very sure you wouldn't have allowed this company to invest in Malaysia if you were still the Prime Minister.

Its great to see that you have started a blog, which is seriously lacking among our current BN leaders. They have yet to understand the power and influence of blogging.

Pak Lah has his flaws, that is undeniable. So have some of the other leaders. But shouldnt we be helping BN to regroup and create a unified front? I cant really see the benefit of these public attacks. It only seems to make the opposition stronger and especially Anwar. I fear the day if he ever came into power.

All the best Tun and really wish you were still leading this nation.

There are also a lot of policies and decisions that you have made which made life for a non-Malay like me feel marginalised and felt bitter towards you and your Government.

Saya berpendapat di zaman Tun dahulu, orang melayu cukup berbudi bahasa, kita sedar kita tidak boleh lama berharap pada bantuan kerajaan sahaja dan untuk memajukan diri dan bangsa malaysia kita berubah ke meritokrasi. Malangnya apakala Tun tiada di puncak, melayu UMNO menjadi amat jelek budibahasanya. Hormat-menghormati kaum lain tidak diamalkan dan orang melayu diajak supaya membangga diri tak bertempat. Pasukan pelapis UMNO pula menumpu kepada pembangunan mat rempit dari kebajikan seluruh rakyat negara ini. Saya kira bab perubahan "judiciary" tidak akan berlaku langsung jika tidak kerana kekalahan pilihanraya baru-baru ini. Masalah utamanya ialah kerajaan yang ada ini sangat kuat gembar-gemburnya..Bab implimentasi hem..Harap dengan adanya check dan balance dari pihak Tun. i am happy that under your administration, Malaysia has become KNOWN. i salute you!!!

But sad to say recently, the economy is not coming its way. The goverment wants to go back to agriculture. You set us up to go up, now its seem we are lost now. most companies are not comming in to Malaysia...why Thailand? as you can see most thins are amde in Thailand nowdays. Why Singapore? SEA investment hub? What r the things we lack that the foreign companies see in them? We surely are loosing them (the investers) since you know when. Motorola, Sony, etc. and Why our currency is never at par with singapore..since u know when. and why are we easily
shaken by the world when we ourselves have most of the resources?
Lastly...please tell the leaders not to bring up racial issue!!!

Democracy says that the people have the right to choose their representatives and their government, based on their performance. When the government works with the opposition for the good of the nation, the people stand to gain. It is true that when the government works along the right path, it has to be constantly on its toes to serve the people. That would be the true spirit of public services where the best are there to work for the people, and those in power should not take it as an opportunity to use power, and share among their goons for themselves, and their future generations yet to come.

The government and the opposition are in constant competition to serve the nation. Government should not be an economic sector for people to trade their power for wealth. It is not a place for the powers-that-be to mould the mindset of its people so that they would be returned to power, out of fear for change, as has been happening here for the past 50 years.

Politicians turn statesmen are rewarded with having their names in history, appreciated by future generations for their contribution to social and economic progress in the country.

I feel more comfortable if the country is led by those with science background - doctors, engineers, architects, IT specialists - because these people are trained to live with verbs like to create, to solve, to design, to build, to develop, to treat, to research, and analyze. I feel very unsecured if the country is led by lawyers (read: liars). Menteri Besar of Perak is an engineer, so is Nurul Izzah. Her mother was a dentist... :)
I went to the book fair last month but no minister (except for TPM for the launching ceremony) from BN appeared in public. I wonder if they read at all. A good leader is someone who reads and writes. You were not perfect when you were our PM but as yet, you're still the best :)

The country is in a big mess...subsidy mentality ballon the cost to about $50B a year. Abolish the subsidy through open economy-absolutely no cartel or monopolies on all trades and imports,exports.....You will see prices come down very fast eg transport(no more AP butagaji),custom clearance (no more alibaba), free importof any items by any parties will see goods prices come down. More must be done on breakdown vehicle APs as it benefit minorities with majorities feedding their pocket..no good for businessman.
Let us do a drastic action to free us on viscious circles

Nampaknya makin banyak blog yang kita kena baca. Dari blog Ali Rustam, Khir Toyo dan Muhammad Muhd Taib, kini blog Tun muncul mewarnai alam bloggers yang semalam pihak SPR secara sinis memberi amaran akan memantau blog-blog yang bercambah macam cendawan dan memusnahkan BN baru-baru ini.

Harapan saya kepada Y.Bhg. Tun agar Tuan ber blog secara ikhlas supaya maklumat dan ulasan yang di "post" kan akan memberi manfaat kepada seluruh rakyat di negara ini terutama kepada mereka yang sayangkan Malaysia.

It is time for you to rest and relax. Do you really think that you did very well when you were the Education Minister ? You were the one that changing the English media of instruction to Bahasa ! You had made a wrong decision on this ! Before that, Malaysians students were among the best students in the overseas studying in UK, USA, Australia, Canada, NZ and etc that they had excelled vey well academically. However, due to shifting the Media of instruction to Bahasa in 1975 in secondary schools, which proposed by you, and that time I was the first year of change in my secondary school, Malaysian students had found difficulties in adpating to English media of instruction in oversea unversities, which had great effect and setback in most students. You had done wrongly in changing that: an unexcused mistake ! You have put many Malaysian students in dilemma ! Pls clarify this. You wer the one that caused the academic downfalls among Malaysian students ! You put the Malaysian educational system in junction as today !!! Many think that this had led to today's failure in Malaysian educational systems. What do you think ? How many good English books have been translated to bahasa each year ? Your decision had caused many Malaysian not able to communicate well in English...Royalty to Malaysia not neccesary we must speak bahasa ! Not speaking bahasa does not mean that we are not loved our country. Regretted your decision. Pls comment. Thanks.

I have several books on you and by you. Some of them are critical of you as you may well expect. As you have said, history will judge you, fairly or otherwise. I pray writers would not ignore the facts, even if they don't share the sentiments.
I'm contributing my comments here to encourage you to continue to speak out.This country needs a voice like yours to lend guidance to the present leadership which is at a loss. I'm a retiree, and in all my years I have never seen such ineptitude in the office of the PM.
Not everybody will agree with you, Tun. I don't have to remind you, of all people.But I'm one person who has benefitted from the opportunities made availble to me by the Government of your time, and it is much too little gratitude for me to say you can count on my support.

I just log on to Rocky Bru and when I read 'Che Det now A blogger' I straight away click on the link and WOW! 233 comments and a fresh new article The appointment of Judges; from a statesman himself. Tun dont worry about those negative comments made by people who dislike you, in fact deep inside them they love you, otherwise they wont be going down to KLCC every weekend and enjoy the food, sceneary etc. Otherwise they will not travel on the highways, otherwise they will have a hard time explaining to the foreigners 'where Malaysia ' is whenever they are at overseas, In fact when I am at overseas when they ask me where I am and when I mentioned 'Malaysia' they smile anq quote 'MAHATHIR' oo yeahh,otherwise without your strategic plan and action in 1998, they will not walk tall. Those who hates you will regret when you are no longer in this world. Those leader who critizes and condemed you will then praise you as high as the mountain but its too late, anyway that's human otherwise we all be angel.Tun, you dont have to show us your report card like what Abdulah and his companion did, becasue we dont need it to justify what you have done to Malaysia and us. What I think about the appontment of Judges is just a life line to guarantee the survival of Abdullah and his companion, it's nothing more that a political move.By the way Tun Salleh Abbas is,were, was and still am a politican rather and his fight for justice is merely political and not justice. Have he use all the avenue he has?. None, he didnt even defend himself neither file an appeal but rather took the fight into a political manner.It the same to the bar council,their interest is more than the people interest. Tun Salled did constest a parlimentary seet aint him. May Tun should shred some light on Tun Salleh Abbas issue. Let hear it from the grandmaster .Tun, welcome to the world of blogging.

Dalam pembentukan Suruhanjaya Kehakiman ini, memang banyak isu dan faktor yang perlu diambilkira dengan teliti. Saya berpendapat, apa yang sedia ada sudah cukup baik. Tidak ada sistem yang sempurna apatah lagi kalau manusia yang menjalankannya tidak cukup kemampuan.

Sebagai pemimpin Paklah harus memiliki keupayaan untuk membuat penilaian berdasarkan kepercayaan dan keyakinannya sendiri kerana dialah yang akan mengepalai sesuatu sistem itu dan bukan orang lain. Dia tak boleh mengubah sesuatu yang sebesar dan sesensitif sistem perlantikan hakim kanan hanya kerana orang kata dia perlu mengubahnya.

Dia kena ingat bahawa menubuhkan Suruhanjaya Kehakiman itu bukan saja boleh melepaskan dirinya dari tanggungjawab, atau boleh kerja senang sikit tetapi juga boleh melepaskan salah sebuah institusi yang menjadi tunggak negara kepada orang atau pihak lain.

Kurang cerdik tu satu perkara, tapi janganlah sampai jadi tunggangan pihak yang mungkin mahu mengambil kesempatan.

Tun, first of all I would like to express my congratulation to your new blog.

I have few questions wish to share with Tun. Firstly,do you still remember who was the person who started the Judicial Crisis 1988? Who was the UMNO member who so afraid that the judgment by court in UMNO 11's case will not in favour of party UMNO? Facts will no be changed if that person merely denied everything that he had done to the judiciary and the country.

Secondly, how PAk Lah's cabinet want to propose for Judicial Commissioner on Appointment of Judges would be same as how your cabinet in 1988 proposed in Parliament the to delete the power of Courts provided in pre-Article 121 of the Federal Constitution. I see no point why current shouldn't work hand-in-hand with the MP from PAkatan RAkyat. Parliament is one of the branches under Federal Constitution. Inherent power of Parliament is to check and balance the act of executive and judiciary. No strong ideology of politic should be taken when policy being discussed in Parliament. The mindset of the politician should be changed now. Rakyat don't want to see the MP and politician who only how to do politic but no other things for the benefit of the country and people. Tun, your way to gain power in politic had been rejected by people in 12th General Election.

Justice must be done and I think Pak Lah taken his first step to rebuild the judiciary in Malaysia. we shall wait and see what plan he has in his mind.

Assalamu'alaikum. Selamat datang Uncle Mahathir (UM) ke dunia ketukan papan kekunci yang bisa mengalahkan kesan gegaran gunung berapi ! Harap UM sentiasa ikhlas dan sabar dalam memblog. Terus telus tidak seperti blogger politik yang lain yang terpaksa menutup komen selepas beberapa ketika membukanya.

Mengenai isu ini, hakikatnya memang telah nyata kerajaan itu lemah dan bukan hanya apabila kerajaan terpaksa "bekerjasama" dengan pembangkang dalam meluluskan apa-apa undang-undang.

Semua pihak kena berfikir secara terbuka. Mana yang baik, MP harus beri sokongan dan bukan hanya semata-mata "saya menurut perintah" atau keputusan parti.

Memang calon yang bertanding atas tiket parti tetapi ada juga yang diundi kerana personaliti mereka sendiri, oleh kerana itu mereka perlu bebas membuat undian.

Jika sekiranya kerajaan atau pembangkang perlu senada dengan keputusan parti masing-masing, itu bermakna selagi tiada pihak berjaya memenangi 2/3 kerusi parlimen, undang-undang tidak akan dapat diubah ! (lainlah kalau undang-undang yang sedia ada sempurna tiada cacat cela sepanjang zaman).

Sudah sampai ketikanya kita mesti lebih matang berpolitik, bijak berpencak.

Many years back there was a world wide poll on who is the most ungreatful people of person. Well the world polled and The Malays came out on top! As the "Most Ungreatful Bast@%$'s in The World".
The malaysa owe it to you in making the world see who they are, you put the Melayu on the world map. They used to think malays were living on trees and built houses on trees and stilts to stay away from tigers, this was until late 80's. You made the world see Malaysia and recognise us as a force to reckon with. The Malays fully benefitted from your leadership and became Millionaires and Billinaires. The Super Rich Malay class was created during your tenure, you made the world see who the melayu are, but really who is the Melayu??? Where they came from??

I am dissapointed about your comment that working with the opposition party is a sign of weakness. Your comment shows a lack of political maturity.

I am a Malaysian currently working and living in Australia. I chose to migrate because I felt that M'sia was no place to bring up my kids who would be classified as non-bumis.

Your comments demonstrates to me I have made the right decision for the sake of my family.

Even though Pak Lah is seen to be "weak" by many, he is at least making good reforms and heading in the right direction.

You may have brought greatness to Malaysia but you must admit, if only to yourself, that a lot of the problems we Malaysians are facing today is of your own doing.

It's really great to hear from you again, if not from the TV set. I used to catch all the news commentaries by you on TV when you were a PM, but now not anymore. What I hear from TV now is boring speeches, it doesn't live up my spirit at all after listening to what the PM said (I even want to fall asleep). I could not help it that I turn off the TV. The leaders who speak today never use their brain to think before they act (keris) or open their mouth (bocor).


Sadly I have never met you before, to thank how much prosperity you have brought to Malaysia. You have created so many icons for Malaysia; KLCC, KL Tower, Putrajaya, KLIA and etc. The world knows Malaysia because of your vision.

Charisma. Vocal. Brave. No leaders in Malaysia come close to your quality.

Lastly, I wish you the best of health. Blog comments can be brutal (sometimes), just don't take it too seriously dear Tun. You are in your golden age, take it easy and enjoy your time with your family and friends.

I have met people overseas that do not know anything about Malaysia but they know the Twin Towers and they know Sepang. You were a strong and articulate leader that provided a voice to the less heard nations and among the Muslim nations you were widely respected.

At the same time your oppression and active suppression of a free and fair media and use of draconian laws such as the ISA for your political expediencies, the rot in our judicial system, the rise of UMNO putraism, lack of transparency, spiraling corruption due to your inaction and wanton abuse of power of Little Napoleons that acted in the name of Malay and Islamic supremacy has created a polarised society and is a big black spot in your legacy.

I believe no one leader is perfect otherwise you would not be human. I hope your new role as the government's discipline master would in some way make amends for your shortcomings.

Let us work together for a truly united and prosperous nation where every citizen has equal rights and opportunities and is treated fairly and equally before the law. I hope you will appreciate the frustrations of almost half the citizens who feel even though we are born and bred in Malaysia and love this nation as much as the Malay next door still feel as if we are "tolerated" in our own country and have to grapple with a long list of inequalities from scholarships to job opportunities, licenses, promotions (civil service) and so on.

As GE 2008 has proven there is hope. Even for a UMNOPutrafied Malaysia.

Long live Malaysia. God Bless Malaysia.

What you did for your 20 plus years as a leader of Malaysian was just to enrich yourself and your cronies.
