1. When the Government gave ex-gratia payments to the judges involved in the Tun Salleh Abas removal as the Lord President of Malaysian courts, the question that needs to be answered is whether it is because of Government regrets over something that happened not during the period this Government was in power or is it because of a desperate attempt to win support after the disastrous results of the election of 2008.
2. Had the present Government felt regret, it should have paid ex-gratia payment (for want of a better term) upon achieving power. But obviously it only felt regret lately, after its brand new de facto Minister of Law, who incidentally was suspended for money politics, suggested the move in order to win the approval of the Bar Council.
3. But what was at the back of this political feeling of guilt by this Government. Was it because of the injustice done? Or was something unfair and unlawful committed by the previous Government.
4. Most people know about Tun Salleh’s dismissal but few care to find out what really happened. Some believe that the action against Tun Salleh was because he had proposed a panel of 12 judges to hear the appeal against Judge Harun Hashim’s findings that UMNO was an illegal organisation. Others believe it was because he was biased against UMNO in his judgements.
5. None of these is true. Tun Salleh had not been biased against the Government. He dismissed the application by Lim Kit Siang in the case involving UEM and the Government, for an interim injunction made by a lower court in a lengthy judgement made by him as President of the Supreme Court. In numerous other cases his judgement favoured the Government. As to the panel to hear the appeal against Judge Harun Hashim’s findings, a bigger panel could actually be good for UMNO, which wanted nothing more than the validation of the election results making me President and Ghafar Baba Deputy President. Whether the panel rejects or approves Judge Harun’s decision, UMNO and UMNO Baru would not be affected.
6. The truth is that the case against Tun Salleh was triggered by his letters to the Yang di Pertuan Agong which were considered by the Agong as being highly improper and insulting to him.
7. In his first letter Tun Salleh had written to DYMM YDP Agong complaining about the noise made during some repair work at the Agong’s palace near Salleh’s house.
8. This alone can be considered as very improper. A man as senior as he was could have asked to see the Agong and verbally informed him about the noise.
9. But to compound the act of les majesté he sent copies of his letter to the other rulers. This implied that he did not have faith in the Agong and wanted the other Rulers to apply pressure on him.
10. This was followed by another letter to DYMM YDP Agong complaining about the behaviour of the executive i.e. the Prime Minister. Copies of this letter were also sent to the other Rulers.
11. In this letter Tun Salleh said inter alia, “All of us (the judges) are disappointed with the various comments and accusations made by the Prime Minister against the judiciary not only outside but inside Parliament.”
12. He went on to say in his letter “the accusations and comments have brought shame to all of us and left us mentally disturbed to the extent of being unable to discharge our functions orderly and properly.”
13. He asserted that he and all the judges “do not like to reply to the accusations publicly because such action is not compatible with our position as judges under the Constitution …. And as such it is only proper for us to be patient in the interest of the nation.”
14. This statement was obviously untrue as before the letter was sent, in a speech at the University of Malaya when he was receiving his honorary doctorate, he complained about “the judiciary being placed in the social service category” inferring that this was not in keeping with “the rule of law” and that the “priority of the courts should be altered so that freedom is guaranteed and work is not disturbed.”
15. He went on to say “the officers of the public service (i.e. judges) do not have a lesser role and function to play than the roles played by the politicians.”
16. Further he said, “This matter becomes aggravated if the rights involved in a decision made by an official are related to judicial matters because this will result in a very important question that is interference with the independence of the judiciary.”
17. Again when making a speech at the launching of a book “Law, Justice and the Judiciary, Transnational Trends” Tun Salleh had said, among other things, “The vital constitutional principle is so settled that no question should really arise concerning the position of the judiciary under the Constitution. But recently this guardianship has been made an issue and our independence appears to be under some kind of threat.” He added, “This is amply borne out by some of the comments made recently which embarrassed the judiciary a great deal. These remarks not only question our neutrality and independence but the very value of it as an institution ….. Our responsibility of deciding the case without fear or favour …. does not mean that the court decision should be in favour of the Government all the time…….”
18. “Apart from this,” he continued, “the problem of maintaining judicial independence is further complicated by the fact that the judiciary is the weakest of all the three branches of the Government.”
19. “What matters most in order to enable us to save the system from disastrous consequences is that we judges must act with responsibility and dignity and not be drawn or tempted into an impulsive action which could only result in aggravating the situation.”
20. These two speeches were delivered on 1st August 1987 and 12th January 1988 respectively. But Tun Salleh’s letter to the King was dated 26th March 1988. As I pointed out earlier it is not true that he did not speak about his accusations against the Government in public because he maintains that “such action is not compatible with our position as judges under the Constitution” and that “it is only proper for us to be patient in the interest of the nation.”
21. All his statements in these two speeches clearly contain his criticisms of the Prime Minister and the Government long before he wrote his letter to the King.
22. Another point raised in his letter to the Agong is that “the accusations and comments have brought shame to all of us (judges) and left us mentally disturbed to the extent of being unable to discharge our functions orderly and properly.”
23. In Section 125 of the Federal Constitution, under clause (3) the grounds for removing a judge, apart from misbehaviour include infirmity of body or mind or any other cause, properly to discharge the functions of his office.”
24. By his own admission Tun Salleh was not able “to discharge his functions orderly and properly.” He was therefore unfit to continue to be a judge.
25. Section 125, Clause 4 provides for “the Yang di Pertuan Agong to appoint a Tribunal …. and refer the representations to it, and may on the recommendation of the tribunal remove the judge from office.”
26. The two letters from Tun Salleh were regarded by the Agong as being highly improper and insulting particularly the copies sent to the other Rulers.
27. During one of my weekly meetings with the Agong, DYMM expressed his annoyance over the letters and simply requested that I dismiss Tun Salleh Abas from being the Lord President of the Malaysian Courts. He writes in his own handwriting his request on the margin of Tun Salleh’s first letter, regarding the noise made by the work on the Agong’s residence.
28. To the Agong it was a simple matter. He had appointed the Lord President and therefore he was entitled to remove him. I thought it was best for me to inform Cabinet and seek the advice of the Attorney-General.
29. I must admit that Tun Salleh’s complaints against me in his letter annoyed me. It is true that I had criticised the judges for interpreting the laws passed by Government not in accordance with the intention or objective of the laws. I did suggest that if the laws were interpreted differently from what the Government and the legislators intended, then we would amend the laws. During a cabinet meeting I had in jest quoted Shakespeare’s words, “The first thing we do we hang the lawyers.” Only a nitwit would think that I meant what I said literally. But apparently lawyers and judges took umbrage over what I said and regarded me as their enemy (about to hang them, I suppose).
30. I also criticised judges for making laws themselves through their interpretations and subsequently citing these as their authority. I believed that the separation of powers meant the Legislators make laws and the judiciary apply them. Of course if the laws made by the legislators breach the provisions of the constitution, the supreme law of the land, then judges can reject them.
31. Again some judges simply refused to hear cases involving the death penalty, pushing these unfairly on to other judges.
32. It is the view of most jurists that “It is not wrong for any member of the public or the administration to criticise the judiciary. “Justice is not a cloistered virtue.” (Peter Aldridge Williams QC).
33. The above writer quoted McKenna J “There is no difference between the judge and the Common Man except that one administers the law and the other endures it.”
34. Yet Tun Salleh took the view that I was subverting the independence of the judiciary when I expressed views on how judges frustrated the objectives of the legislators.
35. Through the grapevine I heard of the judges’ displeasure with me. But I did not take any action, certainly not to remove Tun Salleh. I only acted after the Agong complained about the two letters.
36. The Cabinet agreed that we must adhere strictly to the provisions of the Constitution. I therefore advised the Agong that Tun Salleh could not be removed unless the Agong appoints a Tribunal to hear the complaints against him and make recommendations to the Agong.
37. Upon the Agong agreeing, the Government selected six judges and former judges for His Majesty to consider. The members included foreign judges in the person of the Honourable the Justice K.A.P. Ranasinghe, Chief Justice Democratic Socialist Republic of Sri Lanka and the Honourable Mr Justice T.S. Sinnathuray, Senior Judge of the Supreme Court of Singapore.
38. The Chairman was the Chief Judge (Malaya), Tan Sri Dato Abdul Hamid bin Hj Omar. The other members were Dato Sri Lee Hun Hoe, Chief Justice (Borneo), Tan Sri Abdul Aziz bin Zain, Retired Judge and Tan Sri Mohd Zahir bin Ismail, Retired Judge.
39. The inclusion of foreign judges was to make sure the Tribunal would not be biased.
40. It is unfortunate that Tun Salleh Abas refused to appear before the Tribunal. Instead he depended on his colleagues to try to prevent the findings of the Tribunal from reaching the Yang di Pertuan Agong.
41. What the five judges who were sympathetic to him did was certainly not in keeping with Tun Salleh’s expressed views in his talk during the launching of the book “Law, Justice and the Judiciary. Transnational Trend, “when he said “we as judges must act with responsibility and dignity and not be drawn or tempted into any impulsive action which could only result in aggravating the situation.”
42. The five judges had ignored rules and procedures and the requirement to get the approval of the (Acting) Lord President, as well as wait for the findings by Mr Justice Ajaib Singh on the same matter. Instead they cancelled courts sittings in Kota Bahru which were scheduled for the judges, and held a sitting of the Supreme Court in Kuala Lumpur to hear an application by Tun Salleh Abbas for prohibition proceedings to determine his position.
43. The Supreme Court of five judges with Tan Sri Wan Sulaiman presiding heard an ex parte oral application by Tun Salleh’s lawyer, retired for a few minutes, returned and unanimously made an order for stay restraining the Tribunal from submitting any recommendations, report or advice respecting the enquiry to His Majesty the Yang di Pertuan Agong until further order.
44. Subsequently the Acting Lord President, set up a Supreme Court of five judges which negated the decision of the Wan Suleiman Court.
45. I would like to repeat that despite public criticisms made against me by Tun Salleh, I did not take any action against him. I only did so after he insulted the Agong and the Agong requested me to have him removed. Of course some would still say I influenced the Agong. But throughout my 22 years I had never involved the rulers in politics or my personal problems. The records are there for all to see.
46. I was very concerned over the forcible removal of Tun Salleh. And so I tried to get Tun Salleh to resign on his own so as to avoid a scandal. He agreed at first but he withdrew the following day.
47. I then went about getting the Tribunal approved and set up. Naturally I had to consult the Attorney-General and others who were familiar with judges. Once the Tribunal was set up my involvement ended.
48. When Tun Salleh and the other judges had their services terminated, they should not be paid their pensions. But following appeals by Attorney-General I agreed that they should be paid their full pensions. They therefore did not suffer any financial loss and their pensions were computed from the time they left.
49. These are the facts relating to the dismissal of Tun Salleh. It was he and his fellow judges who brought disrepute to the judiciary.
50. I write this to record things as they happened. I do not expect my detractors to stop saying that I destroyed the judiciary. They are my prosecutors and they are also my judges. To them I will always be the Idi Amin of Malaysia as claimed in Tun Salleh’s book “May Day for Justice”. Sadly many who so readily condemn me were judges.

KISAH TUN SALLEH
1. Apabila Kerajaan memberi bayaran ex-gratia kepada para hakim yang terlibat di dalam penyingkiran Tun Salleh Abas sebagai Ketua Hakim Mahkamah Malaysia, persoalan yang perlu dijawab ialah adakah ianya kerana Kerajaan kesal terhadap sesuatu yang berlaku di zaman sebelum Kerajaan ini berkuasa atau adakah ianya langkah terdesak untuk mengembalikan sokongan selepas keputusan buruk Pilihanraya Umum 2008.
2. Jika Kerajaan hari ini merasa kesal, bayaran ex-gratia (memandangkan tiada lagi perkataan yang lebih sesuai) sepatutnya dibuat selepas ianya mula berkuasa. Jelas sekali ia hanya merasa kesal baru-baru ini, selepas Menteri baru yang dipertanggungjwabkan ke atas hal-ehwal kehakiman (yang juga pernah digantung kerana penglibatan dalam politik wang) mencadangkannya sebagai langkah untuk memenangi hati Majlis Peguam.
3. Tetapi apakah yang menyebabkan perasaan kesal “politik” di pihak Kerajaan ini? Adakah kerana berlaku ketidak adilan? Atau adakah Kerajaan yang sebelumnya berlaku berat sebelah atau melanggar undang-undang?
4. Kebanyakan orang tahu tentang penyingkiran Tun Salleh tetapi tidak ramai yang mengambil berat tentang apa yang sebenarnya berlaku. Sesetengah pihak percaya yang tindakan terhadap Tun Salleh disebabkan cadangannya membentuk panel 12 hakim untuk mendengar rayuan terhadap keputusan Hakim Harun Hashim yang telah mendapati UMNO sebagai sebuah organisasi haram. Ada pihak lain yang percaya ianya kerana beliau tidak menyebelahi UMNO di dalam penghakimannya.
5. Tidak ada satu pun yang benar. Tun Salleh tidak berat sebelah terhadap Kerajaan. Dia telah menolak permohonan Lim Kit Siang di dalam kes yang melibatkan UEM dan Kerajaan, terhadap injunksi sementara yang dibuat mahkamah rendah di dalam keputusan penghakiman yang panjang yang dibuat olehnya sebagai Presiden Mahkamah Agong (sekarang Mahkamah Persekutuan). Di dalam kes-kes lain penghakiman beliau banyak berpihak kepada Kerajaan. Berkenaan dengan panel untuk mendengar rayuan terhadap keputusan Hakim Harun Hashim, panel yang lebih besar mungkin lebih baik bagi UMNO yang hanya mahukan pengesahan keputusan pemilihan yang akan menjadikan saya Presiden dan (Tun) Ghafar Baba Timbalan Presiden. Samada panel menolak atau menerima keputusan Hakim Harun, ianya tidak akan memberi kesan terhadap UMNO dan UMNO Baru.
6. Sebenarnya kes terhadap Tun Salleh tercetus kerana surat-suratnya kepada Yang di Pertuan Agong yang baginda anggap melanggar tatasusila serta menghina.
7. Di dalam surat pertamanya, Tun Salleh telah menulis kepada DYMM YDP Agong untuk mengadu berkenaan bunyi bising kerana kerja-kerja baikpulih di Istana YDP Agong yang terletak berdekatan dengan rumah Tun Salleh.
8. Ini sahaja boleh dianggap melanggar tatasusila. Seseorang yang begitu kanan kedudukannya boleh meminta izin untuk mengadap YDP Agong dan menyampaikan aduannya secara lisan.
9. Untuk memburukkan lagi perbuatan menghina Istana dia telah menghantar salinan suratnya kepada Raja-Raja lain. Ini seolah-olah menunjukkan yang dia tidak punyai keyakinan terhadap YDP Agong dan menghendakkan Raja-Raja Melayu lain untuk mengadakan tekanan terhadap YDP Agong.
10. Ini kemudiannya disusuli dengan satu lagi surat kepada YDP Agong yang mengadu berkenaan tindak-tanduk eksekutif iaitu Perdana Menteri. Salinan surat ini juga telah dihantar kepada Raja-Raja.
11. Di dalam surat ini, Tun Salleh telah menyatakan antara lain; “All of us (the judges) are disappointed with the various comments and accusations made by the Prime Minister against the judiciary not only outside but inside Parliament.” [Kami (para hakim) kecewa dengan pelbagai kenyataan dan tuduhan yang dibuat Perdana Menteri terhadap badan kehakiman bukan sahaja di luar malahan di dalam Parlimen]
12. Dia seterusnya berkata di dalam suratnya “the accusations and comments have brought shame to all of us and left us mentally disturbed to the extent of being unable to discharge our functions orderly and properly.” [tuduhan-tuduhan dan kenyataan-kenyataan yang dibuat telah memalukan kami semua dan telah meninggalkan kesan kekacauan mental sehinggakan kami tidak dapat menjalankan tugas kami dengan tertib dan teratur].
13. Dia menegaskan yang dia dan para hakim semua “do not like to reply to the accusations publicly because such action is not compatible with our position as judges under the Constitution …. And as such it is only proper for us to be patient in the interest of the nation.” [tidak mahu membalas secara terbuka tuduhan kerana tindakan tersebut tidak bersesuaian dengan kedudukan kami sebagai hakim di bawah Perlembagaan…dan oleh itu adalah lebih baik kami bersabar demi kepentingan Negara].
14. Kenyataan ini nyata tidak benar kerana sebelum surat tersebut diutuskan, di dalam satu ucapan di Universiti Malaya di mana dia dianugerah ijazah doktor kehormat, dia telah merungut berkenaan “the judiciary being placed in the social service category” (badan kehakiman ditempatkan di bawah kategori perkhidmatan sosial) dengan membuat kesimpulan bahawa ini tidak bertepatan dengan “the rule of law” (kedaulatan undang-undang) dan oleh itu “priority of the courts should be altered so that freedom is guaranteed and work is not disturbed” (keutamaan mahkamah harus diperbetulkan agar kebebasan dijamin dan kerja tidak terganggu).
15. Dia seterusnya berkata “the officers of the public service (i.e. judges) do not have a lesser role and function to play then the roles played by the politicians” (pegawai perkhidmatan awam iaitu para hakim tidak memainkan peranan yang kurang pentingnya berbanding yang dimainkan ahli politik).
16. Beliau juga berkata, “This matter becomes aggravated if the rights involved in a decision made by an official are related to judicial matters because this will result in a very important question that is interference with the independence of the judiciary” (Keadaan ini diburukkan lagi jika hak yang terlibat dalam keputusan yang dibuat para pegawai adalah berkaitan soal penghakiman kerana ini akan menimbulkan soalan penting iaitu campur tangan dalam kebebasan kehakiman.
17. Sekali lagi apabila berucap semasa melancarkan buku “Law, Justice and the Judiciary, Transnational Trends” Tun Salleh berkata, antara lain, “The vital constitutional principle is so settled that no question should really arise concerning the position of the judiciary under the Constitution. But recently this guardianship has been made an issue and our independence appears to be under some kind of threat.” (Prinsip Perlembagaan yang penting sudahpun termaktub oleh itu tidak timbul soal kedudukan kehakiman di bawah Perlembagaan. Tetapi baru-baru ini perlindungan ini telah menjadi satu isu dan kebebasan kita ternampak seolah-olah sedang dicabar) Beliau menambah, “This is amply borne out by some of the comments made recently which embarrassed the judiciary a great deal. These remarks not only question our neutrality and independence but the very value of it as an institution ….. Our responsibility of deciding the case without fear or favour …. does not mean that the court decision should be in favour of the Government all the time…….” (Ini terhasil daripada sesetengah kenyataan yang dibuat baru-baru ini yang telah benar-benar memalukan badan kehakiman. Kenyataan tersebut bukan sahaja mempersoalkan keberkecualian dan kebebasan kita, tetapi juga nilai badan kehakiman sebagai sebuah institusi…tidak semestinya keputusan mahkamah harus sentiasa menyebelahi Kerajaan)
18. Selain itu beliau menyambung, “the problem of maintaining judicial independence is further complicated by the fact that the judiciary is the weakest of all the three branches of the Government.” (Masalah mengekalkan kebebasan kehakiman dibuat lebih rumit kerana badan kehakiman adalah yang paling lemah diantara ketiga-tiga cabang Kerajaan).
19. “What matters most in order to enable us to save the system from disastrous consequences is that we judges must act with responsibility and dignity and not be drawn or tempted into an impulsive action which could only result in aggravating the situation.” (Apa yang penting untuk selamatkan system ini daripada malapetaka ialah kita para hakim mesti bertindak dengan penuh tanggungjawab dan hormat dan tidak dipengaruhi tindakan gelojoh yang mungkin akan memburukkan lagi keadaan)
20. Kedua-dua ucapan tersebut disampaikan pada 1hb Ogos 1987 dan 12hb Januari 1988. Tetapi surat Tun Salleh kepada YDP Agong bertarikh 26hb Mac 1988. Seperti yang saya nyatakan tadi adalah tidak benar beliau tidak bercakap berkenaan tuduhannya terhadap Kerajaan di hadapan khalayak ramai hanya kerana dia mempertahankan yang “tindakan tersebut tidak bersesuaian dengan kedudukan kami sebagai hakim di bawah Perlembagaan” dan “oleh itu adalah lebih baik kami bersabar demi kepentingan Negara”.
21. Semua kenyataannya di dalam dua ucapan yang disampaikan jelas mengandungi kecamannya terhadap Perdana Menteri dan Kerajaan, jauh lebih lama sebelum dianya menulis surat kepada YDP Agong.
22. Satu lagi perkara yang dibangkitkan di dalam suratnya kepada YDP Agong ialah “the accusations and comments have brought shame to all of us (judges) and left us mentally disturbed to the extent of being unable to discharge our functions orderly and properly.” [tuduhan-tuduhan dan kenyataan-kenyataan yang dibuat telah memalukan kami dan telah meninggalkan kesan kekacauan mental sehinggakan kami tidak dapat menjalankan tugas kami dengan tertib dan teratur].
23. Di bawah Seksyen 125 Perlembagaan Persekutuan, klausa (3) peruntukan untuk memecat hakim, selain daripada salahlaku termasuk ketidakupayaan tubuh badan atau pemikiran atau lain lain sebab, untuk menjalankan tugas-tugas jawatan dengan saksama.
24. Tun Salleh sendiri mengakui yang beliau tidak terdaya untuk melakukan tugas-tugasnya dengan teratur dan tertib. Oleh itu beliau tidak layak untuk terus menjadi hakim.
25. Seksyen 125, klausa 4 memperuntukkan kuasa YDP Agong melantik Tribunal dan boleh atas nasihat Tribunal menyingkirkan hakim daripada kedudukannya.
26. Kedua-dua surat daripada Tun Salleh dianggap YDP Agong sebagai tidak sesuai dan menghina terutamanya kerana salinannya dihantar kepada Raja-Raja Melayu lain.
27. Di dalam salah satu daripada mesyuarat mingguan saya dengan YDP Agong, baginda telah menyatakan ketidak puasan hatinya terhadap surat-surat tersebut dan telah meminta saya menyingkir Tun Salleh Abas daripada jawtan Ketua Hakim Negara. Baginda telah menulis sendiri permintaan baginda di ruangan tepi (margin) surat pertama Tun Salleh berkenaan dengan bunyi bising daripada kerja-kerja yang sedang dijalankan di kediaman YDP Agong.
28. Bagi YDP Agong ianya adalah perkara mudah. Baginda yang melantik Ketua Hakim dan mempunyai hak untuk menyingkirkan beliau. Saya fikir adalah lebih baik bagi saya merujuk perkara ini ke Kabinet dan nasihat Peguam Negara didapati.
29. Saya mengaku rungutan Tun Salleh terhadap saya di dalam suratnya juga menimbulkan ketidak puasan hati saya. Adalah benar yang saya telah mengkritik hakim-hakim kerana mentafsir undang-undang yang dilulus Kerajaan yang tidak menepati matlamat atau objektif undang-undang itu. Saya ada mencadangkan bahawa jika undang-undang yang ditafsirkan berlainan lain daripada matlamat asal sepertimana yang Kerajaan dan penggubal undang-undang harapkan, maka undang-undang tersebut akan dipinda. Di dalam satu mesyuarat Kabinet saya berseloroh dengan memetik kata-kata Shakespeare, “The first thing we do we hang the lawyers.” (Pertama sekali kita gantung semua peguam). Hanya orang yang dungu sahaja akan mengambil bulat-bulat apa yang saya katakan. Tetapi rupa-rupanya para peguam dan hakim telah merasa tersinggung akan apa yang saya kata dan telah menganggap saya sebagai musuh mereka (yang akan menggantung mereka agaknya!).
30. Saya juga telah mengkritik hakim kerana menggubal undang-undang sendiri menerusi tafsiran mereka dan kemudiannya mengguna tafsiran mereka untuk rujukan. Saya percaya pemisahan kuasa bermakna penggubal undang-undang akan menggubal undang-undang manakala hakim akan menggunapakai undang-undang tersebut. Sudah tentu jika undang-undang digubal melanggar peruntukan perlembagaan, yang merupakan undang-undang tertinggi Negara, maka hakim bolehlah menolaknya.
31. Didapati juga sesetengah hakim menolak membicarakan kes-kes melibat hukuman mati, dan diserah secara tidak adil kepada hakim-hakim lain.
32. Kebanyakan pakar undang-undang berpendapat “It is not wrong for any member of the public or the administration to criticise the judiciary. Justice is not a cloistered virtue.” (Tidak salah bagi sesiapa samada dianya orang awam atau ahli pentadbiran untuk mengkritik kehakiman. 33. Penulis di atas juga telah memetik McKenna J “There is no difference between the judge and the Common Man except that one administers the law and the other endures it” (Tidak ada perbezaan di antara hakim dan orang ramai kecuali yang satu mentadbir undang-undang dan yang satu lagi menerima kesannya).
34. Tetapi Tun Salleh berpendapat bahawa saya cuba menghakis kebebasan kehakiman apabila saya menyatakan pandangan saya bagaimana hakim mengecewakan matlamat asal penggubal undang-undang.
35. Menerusi pelbagai sumber saya dengar akan kemarahan hakim-hakim terhadap saya. Tetapi saya tidak mengambil apa-apa tindakan, jauh sekali untuk menyingkir Tun Salleh. Saya hanya bertindak apabila YDP Agong menyatakan rasa tidak puas hati berkenaan dua surat tersebut.
36. Kabinet bersetuju yang peruntukan perlembagaan haruslah dipatuhi. Oleh itu saya telahpun menasihatkan YDP Agong bahawa Tun Salleh hanya boleh disingkir jika YDP Agong melantik Tribunal untuk mendengar segala rungutan terhadapnya (Tun Salleh) dan membuat cadangan kepada YDP Agong.
37. Selepas YDP Agong bersetuju, Kerajaan memilih enam hakim dan bekas hakim untuk pertimbangan YDP Agong. Ahlinya termasuk hakim Negara asing yang diwakili Yang Arif Hakim K.A.P. Ranasinghe, Ketua Hakim Sri Lanka dan Yang Arif Hakim T.S. Sinnathuray, Hakim Kanan Mahkamah Agong Singapura.
38. Pengerusi tribunal ialah Hakim Besar (Malaya), Tan Sri Dato Abdul Hamid bin Hj Omar. Lain-lain ahli terdiri daripada Dato Sri Lee Hun Hoe, Hakim Besar (Borneo) dan dua orang bekas hakim iaitu Tan Sri Abdul Aziz bin Zain dan Tan Sri Mohd Zahir bin Ismail.
39. Penyertaan hakim asing adalah untuk mempastikan yang tribunal tidak mengambil sikap berat sebelah.
40. Malangnya Tun Salleh Abas enggan hadir di hadapan Tribunal. Sebaliknya dia mengharapkan yang rakan-rakannya akan cuba untuk menghalang keputusan Tribunal daripada disampaikan kepada YDP Agong.
41. Apa yang dilakukan kelima-lima hakim yang bersimpati kepadanya sudah tentu melanggar apa yang Tun Salleh utarakan semasa berucap di majlis pelancaran “Law, Justice and the Judiciary. Transnational Trend” apabila dia berkata; “we as judges must act with responsibility and dignity and not be drawn or tempted into any impulsive action which could only result in aggravating the situation” (kita para hakim mesti bertindak dengan penuh tanggungjawab dan terhormat dan tidak dipengaruhi tindakan gelojoh yang mungkin akan memburukkan lagi keadaan).
42. Kelima-lima hakim tersebut telah mengenepikan peraturan dan prosidur dan keperluan untuk mendapat kelulusan Pemangku Ketua Hakim, disamping menunggu keputusan Hakim Ajaib Singh di atas perkara yang sama. Sebaliknya mereka membatalkan persidangan mahkamah di Kota Bahru yang telah dijadualkan untuk mereka dan telah mngadakan persidangan Mahkamah Agong di Kuala Lumpur untuk mendengar aplikasi Tun Salleh Abbas untuk mengenepikan prosiding bagi menentukan kedudukannya.
43. Lima hakim Mahkamah Agong yang diketuai Tan Sri Wan Sulaiman mendengar aplikasi ex-parte oleh peguam Tun Salleh, berehat seketika, dan kemudiannya kembali dan sebulat suara mengeluarkan arahan menghentikan Tribunal daripada menyerahkan apa-apa cadangan, laporan atau nasihat berkenaan siasatan kepada YDP Agong.
44. Berikutan itu, pemangku Ketua Hakim telah menubuhkan satu panel lima hakim Mahkamah Agong untuk mengenepikan keputusan Mahkamah Wan Suleiman.
45. Saya ingin ulangi yang walaupun Tun Salleh mengkritik saya secara terbuka, saya tidak mengambil sebarang tindakan terhadapnya. Saya hanya berbuat demikian setelah dia menghina YDP Agong dan baginda meminta supaya dianya disingkirkan. Tentulah akan ada yang berkata bahawa saya telah mempengaruhi YDP Agong. Tetapi selama 22 tahun saya tidak pernah melibatkan Raja-Raja di dalam politik atau masalah peribadi. Rekod tertera untuk sesiapa menelitinya.
46. Saya amat mengambil berat terhadap penyingkiran Tun Salleh secara paksa. Saya telah cuba dapatkan Tun Salleh untuk meletak jawatan bagi mengelak sebarang skandal. Pada mulanya dia bersetuju, tetapi telah menarik balik keesokan harinya.
47. Saya telah mendapatkan kelulusan keahlian Tribunal. Saya telah mendapat nasihat Peguam Negara dan pihak lain yang rapat dengan hakim-hakim. Setelah Tribunal ditubuhkan, penglibatan saya berakhir.
48. Apabila Tun Salleh dan hakim-hakim yang lain diberhentikan perkhidmatan mereka, mereka tidak sepatutnya menerima pencen. Tetapi selepas menerima rayuan Peguam Negara, saya bersetuju yang mereka dibayar pencen penuh. Mereka tidak mengalami apa-apa kerugian wang ringgit dan pencen mereka dikira daripada tarikh mereka meninggalkan jawatan.
49. Inilah fakta bekaitan penyingkiran Tun Salleh. Beliau dan rakan-rakan hakimnyalah yang telah membawa penghinaan kepada badan kehakiman.
50. Saya menulis untuk merekodkan peristiwa sebagaimana ianya berlaku. Saya tidak harap pengkritik saya akan berhenti menuduh saya menghancurkan badan kehakiman. Mereka pendakwa saya dan mereka juga adalah hakim saya. Bagi mereka saya tetap Idi Amin Malaysia sebagaimana yang di dakwa Tun Salleh di dalam bukunya “May Day for Justice”. Malangnya ramai yang begitu tersedia mengutuk saya terdiri daripada hakim-hakim.
1. When the Government gave ex-gratia payments to the judges involved in the Tun Salleh Abas removal as the Lord President of Malaysian courts, the question that needs to be answered is whether it is because of Government regrets over something that happened not during the period this Government was in power or is it because of a desperate attempt to win support after the disastrous results of the election of 2008.
2. Had the present Government felt regret, it should have paid ex-gratia payment (for want of a better term) upon achieving power. But obviously it only felt regret lately, after its brand new de facto Minister of Law, who incidentally was suspended for money politics, suggested the move in order to win the approval of the Bar Council.
3. But what was at the back of this political feeling of guilt by this Government. Was it because of the injustice done? Or was something unfair and unlawful committed by the previous Government.
4. Most people know about Tun Salleh’s dismissal but few care to find out what really happened. Some believe that the action against Tun Salleh was because he had proposed a panel of 12 judges to hear the appeal against Judge Harun Hashim’s findings that UMNO was an illegal organisation. Others believe it was because he was biased against UMNO in his judgements.
5. None of these is true. Tun Salleh had not been biased against the Government. He dismissed the application by Lim Kit Siang in the case involving UEM and the Government, for an interim injunction made by a lower court in a lengthy judgement made by him as President of the Supreme Court. In numerous other cases his judgement favoured the Government. As to the panel to hear the appeal against Judge Harun Hashim’s findings, a bigger panel could actually be good for UMNO, which wanted nothing more than the validation of the election results making me President and Ghafar Baba Deputy President. Whether the panel rejects or approves Judge Harun’s decision, UMNO and UMNO Baru would not be affected.
6. The truth is that the case against Tun Salleh was triggered by his letters to the Yang di Pertuan Agong which were considered by the Agong as being highly improper and insulting to him.
7. In his first letter Tun Salleh had written to DYMM YDP Agong complaining about the noise made during some repair work at the Agong’s palace near Salleh’s house.
8. This alone can be considered as very improper. A man as senior as he was could have asked to see the Agong and verbally informed him about the noise.
9. But to compound the act of les majesté he sent copies of his letter to the other rulers. This implied that he did not have faith in the Agong and wanted the other Rulers to apply pressure on him.
10. This was followed by another letter to DYMM YDP Agong complaining about the behaviour of the executive i.e. the Prime Minister. Copies of this letter were also sent to the other Rulers.
11. In this letter Tun Salleh said inter alia, “All of us (the judges) are disappointed with the various comments and accusations made by the Prime Minister against the judiciary not only outside but inside Parliament.”
12. He went on to say in his letter “the accusations and comments have brought shame to all of us and left us mentally disturbed to the extent of being unable to discharge our functions orderly and properly.”
13. He asserted that he and all the judges “do not like to reply to the accusations publicly because such action is not compatible with our position as judges under the Constitution …. And as such it is only proper for us to be patient in the interest of the nation.”
14. This statement was obviously untrue as before the letter was sent, in a speech at the University of Malaya when he was receiving his honorary doctorate, he complained about “the judiciary being placed in the social service category” inferring that this was not in keeping with “the rule of law” and that the “priority of the courts should be altered so that freedom is guaranteed and work is not disturbed.”
15. He went on to say “the officers of the public service (i.e. judges) do not have a lesser role and function to play than the roles played by the politicians.”
16. Further he said, “This matter becomes aggravated if the rights involved in a decision made by an official are related to judicial matters because this will result in a very important question that is interference with the independence of the judiciary.”
17. Again when making a speech at the launching of a book “Law, Justice and the Judiciary, Transnational Trends” Tun Salleh had said, among other things, “The vital constitutional principle is so settled that no question should really arise concerning the position of the judiciary under the Constitution. But recently this guardianship has been made an issue and our independence appears to be under some kind of threat.” He added, “This is amply borne out by some of the comments made recently which embarrassed the judiciary a great deal. These remarks not only question our neutrality and independence but the very value of it as an institution ….. Our responsibility of deciding the case without fear or favour …. does not mean that the court decision should be in favour of the Government all the time…….”
18. “Apart from this,” he continued, “the problem of maintaining judicial independence is further complicated by the fact that the judiciary is the weakest of all the three branches of the Government.”
19. “What matters most in order to enable us to save the system from disastrous consequences is that we judges must act with responsibility and dignity and not be drawn or tempted into an impulsive action which could only result in aggravating the situation.”
20. These two speeches were delivered on 1st August 1987 and 12th January 1988 respectively. But Tun Salleh’s letter to the King was dated 26th March 1988. As I pointed out earlier it is not true that he did not speak about his accusations against the Government in public because he maintains that “such action is not compatible with our position as judges under the Constitution” and that “it is only proper for us to be patient in the interest of the nation.”
21. All his statements in these two speeches clearly contain his criticisms of the Prime Minister and the Government long before he wrote his letter to the King.
22. Another point raised in his letter to the Agong is that “the accusations and comments have brought shame to all of us (judges) and left us mentally disturbed to the extent of being unable to discharge our functions orderly and properly.”
23. In Section 125 of the Federal Constitution, under clause (3) the grounds for removing a judge, apart from misbehaviour include infirmity of body or mind or any other cause, properly to discharge the functions of his office.”
24. By his own admission Tun Salleh was not able “to discharge his functions orderly and properly.” He was therefore unfit to continue to be a judge.
25. Section 125, Clause 4 provides for “the Yang di Pertuan Agong to appoint a Tribunal …. and refer the representations to it, and may on the recommendation of the tribunal remove the judge from office.”
26. The two letters from Tun Salleh were regarded by the Agong as being highly improper and insulting particularly the copies sent to the other Rulers.
27. During one of my weekly meetings with the Agong, DYMM expressed his annoyance over the letters and simply requested that I dismiss Tun Salleh Abas from being the Lord President of the Malaysian Courts. He writes in his own handwriting his request on the margin of Tun Salleh’s first letter, regarding the noise made by the work on the Agong’s residence.
28. To the Agong it was a simple matter. He had appointed the Lord President and therefore he was entitled to remove him. I thought it was best for me to inform Cabinet and seek the advice of the Attorney-General.
29. I must admit that Tun Salleh’s complaints against me in his letter annoyed me. It is true that I had criticised the judges for interpreting the laws passed by Government not in accordance with the intention or objective of the laws. I did suggest that if the laws were interpreted differently from what the Government and the legislators intended, then we would amend the laws. During a cabinet meeting I had in jest quoted Shakespeare’s words, “The first thing we do we hang the lawyers.” Only a nitwit would think that I meant what I said literally. But apparently lawyers and judges took umbrage over what I said and regarded me as their enemy (about to hang them, I suppose).
30. I also criticised judges for making laws themselves through their interpretations and subsequently citing these as their authority. I believed that the separation of powers meant the Legislators make laws and the judiciary apply them. Of course if the laws made by the legislators breach the provisions of the constitution, the supreme law of the land, then judges can reject them.
31. Again some judges simply refused to hear cases involving the death penalty, pushing these unfairly on to other judges.
32. It is the view of most jurists that “It is not wrong for any member of the public or the administration to criticise the judiciary. “Justice is not a cloistered virtue.” (Peter Aldridge Williams QC).
33. The above writer quoted McKenna J “There is no difference between the judge and the Common Man except that one administers the law and the other endures it.”
34. Yet Tun Salleh took the view that I was subverting the independence of the judiciary when I expressed views on how judges frustrated the objectives of the legislators.
35. Through the grapevine I heard of the judges’ displeasure with me. But I did not take any action, certainly not to remove Tun Salleh. I only acted after the Agong complained about the two letters.
36. The Cabinet agreed that we must adhere strictly to the provisions of the Constitution. I therefore advised the Agong that Tun Salleh could not be removed unless the Agong appoints a Tribunal to hear the complaints against him and make recommendations to the Agong.
37. Upon the Agong agreeing, the Government selected six judges and former judges for His Majesty to consider. The members included foreign judges in the person of the Honourable the Justice K.A.P. Ranasinghe, Chief Justice Democratic Socialist Republic of Sri Lanka and the Honourable Mr Justice T.S. Sinnathuray, Senior Judge of the Supreme Court of Singapore.
38. The Chairman was the Chief Judge (Malaya), Tan Sri Dato Abdul Hamid bin Hj Omar. The other members were Dato Sri Lee Hun Hoe, Chief Justice (Borneo), Tan Sri Abdul Aziz bin Zain, Retired Judge and Tan Sri Mohd Zahir bin Ismail, Retired Judge.
39. The inclusion of foreign judges was to make sure the Tribunal would not be biased.
40. It is unfortunate that Tun Salleh Abas refused to appear before the Tribunal. Instead he depended on his colleagues to try to prevent the findings of the Tribunal from reaching the Yang di Pertuan Agong.
41. What the five judges who were sympathetic to him did was certainly not in keeping with Tun Salleh’s expressed views in his talk during the launching of the book “Law, Justice and the Judiciary. Transnational Trend, “when he said “we as judges must act with responsibility and dignity and not be drawn or tempted into any impulsive action which could only result in aggravating the situation.”
42. The five judges had ignored rules and procedures and the requirement to get the approval of the (Acting) Lord President, as well as wait for the findings by Mr Justice Ajaib Singh on the same matter. Instead they cancelled courts sittings in Kota Bahru which were scheduled for the judges, and held a sitting of the Supreme Court in Kuala Lumpur to hear an application by Tun Salleh Abbas for prohibition proceedings to determine his position.
43. The Supreme Court of five judges with Tan Sri Wan Sulaiman presiding heard an ex parte oral application by Tun Salleh’s lawyer, retired for a few minutes, returned and unanimously made an order for stay restraining the Tribunal from submitting any recommendations, report or advice respecting the enquiry to His Majesty the Yang di Pertuan Agong until further order.
44. Subsequently the Acting Lord President, set up a Supreme Court of five judges which negated the decision of the Wan Suleiman Court.
45. I would like to repeat that despite public criticisms made against me by Tun Salleh, I did not take any action against him. I only did so after he insulted the Agong and the Agong requested me to have him removed. Of course some would still say I influenced the Agong. But throughout my 22 years I had never involved the rulers in politics or my personal problems. The records are there for all to see.
46. I was very concerned over the forcible removal of Tun Salleh. And so I tried to get Tun Salleh to resign on his own so as to avoid a scandal. He agreed at first but he withdrew the following day.
47. I then went about getting the Tribunal approved and set up. Naturally I had to consult the Attorney-General and others who were familiar with judges. Once the Tribunal was set up my involvement ended.
48. When Tun Salleh and the other judges had their services terminated, they should not be paid their pensions. But following appeals by Attorney-General I agreed that they should be paid their full pensions. They therefore did not suffer any financial loss and their pensions were computed from the time they left.
49. These are the facts relating to the dismissal of Tun Salleh. It was he and his fellow judges who brought disrepute to the judiciary.
50. I write this to record things as they happened. I do not expect my detractors to stop saying that I destroyed the judiciary. They are my prosecutors and they are also my judges. To them I will always be the Idi Amin of Malaysia as claimed in Tun Salleh’s book “May Day for Justice”. Sadly many who so readily condemn me were judges.
KISAH TUN SALLEH
1. Apabila Kerajaan memberi bayaran ex-gratia kepada para hakim yang terlibat di dalam penyingkiran Tun Salleh Abas sebagai Ketua Hakim Mahkamah Malaysia, persoalan yang perlu dijawab ialah adakah ianya kerana Kerajaan kesal terhadap sesuatu yang berlaku di zaman sebelum Kerajaan ini berkuasa atau adakah ianya langkah terdesak untuk mengembalikan sokongan selepas keputusan buruk Pilihanraya Umum 2008.
2. Jika Kerajaan hari ini merasa kesal, bayaran ex-gratia (memandangkan tiada lagi perkataan yang lebih sesuai) sepatutnya dibuat selepas ianya mula berkuasa. Jelas sekali ia hanya merasa kesal baru-baru ini, selepas Menteri baru yang dipertanggungjwabkan ke atas hal-ehwal kehakiman (yang juga pernah digantung kerana penglibatan dalam politik wang) mencadangkannya sebagai langkah untuk memenangi hati Majlis Peguam.
3. Tetapi apakah yang menyebabkan perasaan kesal “politik” di pihak Kerajaan ini? Adakah kerana berlaku ketidak adilan? Atau adakah Kerajaan yang sebelumnya berlaku berat sebelah atau melanggar undang-undang?
4. Kebanyakan orang tahu tentang penyingkiran Tun Salleh tetapi tidak ramai yang mengambil berat tentang apa yang sebenarnya berlaku. Sesetengah pihak percaya yang tindakan terhadap Tun Salleh disebabkan cadangannya membentuk panel 12 hakim untuk mendengar rayuan terhadap keputusan Hakim Harun Hashim yang telah mendapati UMNO sebagai sebuah organisasi haram. Ada pihak lain yang percaya ianya kerana beliau tidak menyebelahi UMNO di dalam penghakimannya.
5. Tidak ada satu pun yang benar. Tun Salleh tidak berat sebelah terhadap Kerajaan. Dia telah menolak permohonan Lim Kit Siang di dalam kes yang melibatkan UEM dan Kerajaan, terhadap injunksi sementara yang dibuat mahkamah rendah di dalam keputusan penghakiman yang panjang yang dibuat olehnya sebagai Presiden Mahkamah Agong (sekarang Mahkamah Persekutuan). Di dalam kes-kes lain penghakiman beliau banyak berpihak kepada Kerajaan. Berkenaan dengan panel untuk mendengar rayuan terhadap keputusan Hakim Harun Hashim, panel yang lebih besar mungkin lebih baik bagi UMNO yang hanya mahukan pengesahan keputusan pemilihan yang akan menjadikan saya Presiden dan (Tun) Ghafar Baba Timbalan Presiden. Samada panel menolak atau menerima keputusan Hakim Harun, ianya tidak akan memberi kesan terhadap UMNO dan UMNO Baru.
6. Sebenarnya kes terhadap Tun Salleh tercetus kerana surat-suratnya kepada Yang di Pertuan Agong yang baginda anggap melanggar tatasusila serta menghina.
7. Di dalam surat pertamanya, Tun Salleh telah menulis kepada DYMM YDP Agong untuk mengadu berkenaan bunyi bising kerana kerja-kerja baikpulih di Istana YDP Agong yang terletak berdekatan dengan rumah Tun Salleh.
8. Ini sahaja boleh dianggap melanggar tatasusila. Seseorang yang begitu kanan kedudukannya boleh meminta izin untuk mengadap YDP Agong dan menyampaikan aduannya secara lisan.
9. Untuk memburukkan lagi perbuatan menghina Istana dia telah menghantar salinan suratnya kepada Raja-Raja lain. Ini seolah-olah menunjukkan yang dia tidak punyai keyakinan terhadap YDP Agong dan menghendakkan Raja-Raja Melayu lain untuk mengadakan tekanan terhadap YDP Agong.
10. Ini kemudiannya disusuli dengan satu lagi surat kepada YDP Agong yang mengadu berkenaan tindak-tanduk eksekutif iaitu Perdana Menteri. Salinan surat ini juga telah dihantar kepada Raja-Raja.
11. Di dalam surat ini, Tun Salleh telah menyatakan antara lain; “All of us (the judges) are disappointed with the various comments and accusations made by the Prime Minister against the judiciary not only outside but inside Parliament.” [Kami (para hakim) kecewa dengan pelbagai kenyataan dan tuduhan yang dibuat Perdana Menteri terhadap badan kehakiman bukan sahaja di luar malahan di dalam Parlimen]
12. Dia seterusnya berkata di dalam suratnya “the accusations and comments have brought shame to all of us and left us mentally disturbed to the extent of being unable to discharge our functions orderly and properly.” [tuduhan-tuduhan dan kenyataan-kenyataan yang dibuat telah memalukan kami semua dan telah meninggalkan kesan kekacauan mental sehinggakan kami tidak dapat menjalankan tugas kami dengan tertib dan teratur].
13. Dia menegaskan yang dia dan para hakim semua “do not like to reply to the accusations publicly because such action is not compatible with our position as judges under the Constitution …. And as such it is only proper for us to be patient in the interest of the nation.” [tidak mahu membalas secara terbuka tuduhan kerana tindakan tersebut tidak bersesuaian dengan kedudukan kami sebagai hakim di bawah Perlembagaan…dan oleh itu adalah lebih baik kami bersabar demi kepentingan Negara].
14. Kenyataan ini nyata tidak benar kerana sebelum surat tersebut diutuskan, di dalam satu ucapan di Universiti Malaya di mana dia dianugerah ijazah doktor kehormat, dia telah merungut berkenaan “the judiciary being placed in the social service category” (badan kehakiman ditempatkan di bawah kategori perkhidmatan sosial) dengan membuat kesimpulan bahawa ini tidak bertepatan dengan “the rule of law” (kedaulatan undang-undang) dan oleh itu “priority of the courts should be altered so that freedom is guaranteed and work is not disturbed” (keutamaan mahkamah harus diperbetulkan agar kebebasan dijamin dan kerja tidak terganggu).
15. Dia seterusnya berkata “the officers of the public service (i.e. judges) do not have a lesser role and function to play then the roles played by the politicians” (pegawai perkhidmatan awam iaitu para hakim tidak memainkan peranan yang kurang pentingnya berbanding yang dimainkan ahli politik).
16. Beliau juga berkata, “This matter becomes aggravated if the rights involved in a decision made by an official are related to judicial matters because this will result in a very important question that is interference with the independence of the judiciary” (Keadaan ini diburukkan lagi jika hak yang terlibat dalam keputusan yang dibuat para pegawai adalah berkaitan soal penghakiman kerana ini akan menimbulkan soalan penting iaitu campur tangan dalam kebebasan kehakiman.
17. Sekali lagi apabila berucap semasa melancarkan buku “Law, Justice and the Judiciary, Transnational Trends” Tun Salleh berkata, antara lain, “The vital constitutional principle is so settled that no question should really arise concerning the position of the judiciary under the Constitution. But recently this guardianship has been made an issue and our independence appears to be under some kind of threat.” (Prinsip Perlembagaan yang penting sudahpun termaktub oleh itu tidak timbul soal kedudukan kehakiman di bawah Perlembagaan. Tetapi baru-baru ini perlindungan ini telah menjadi satu isu dan kebebasan kita ternampak seolah-olah sedang dicabar) Beliau menambah, “This is amply borne out by some of the comments made recently which embarrassed the judiciary a great deal. These remarks not only question our neutrality and independence but the very value of it as an institution ….. Our responsibility of deciding the case without fear or favour …. does not mean that the court decision should be in favour of the Government all the time…….” (Ini terhasil daripada sesetengah kenyataan yang dibuat baru-baru ini yang telah benar-benar memalukan badan kehakiman. Kenyataan tersebut bukan sahaja mempersoalkan keberkecualian dan kebebasan kita, tetapi juga nilai badan kehakiman sebagai sebuah institusi…tidak semestinya keputusan mahkamah harus sentiasa menyebelahi Kerajaan)
18. Selain itu beliau menyambung, “the problem of maintaining judicial independence is further complicated by the fact that the judiciary is the weakest of all the three branches of the Government.” (Masalah mengekalkan kebebasan kehakiman dibuat lebih rumit kerana badan kehakiman adalah yang paling lemah diantara ketiga-tiga cabang Kerajaan).
19. “What matters most in order to enable us to save the system from disastrous consequences is that we judges must act with responsibility and dignity and not be drawn or tempted into an impulsive action which could only result in aggravating the situation.” (Apa yang penting untuk selamatkan system ini daripada malapetaka ialah kita para hakim mesti bertindak dengan penuh tanggungjawab dan hormat dan tidak dipengaruhi tindakan gelojoh yang mungkin akan memburukkan lagi keadaan)
20. Kedua-dua ucapan tersebut disampaikan pada 1hb Ogos 1987 dan 12hb Januari 1988. Tetapi surat Tun Salleh kepada YDP Agong bertarikh 26hb Mac 1988. Seperti yang saya nyatakan tadi adalah tidak benar beliau tidak bercakap berkenaan tuduhannya terhadap Kerajaan di hadapan khalayak ramai hanya kerana dia mempertahankan yang “tindakan tersebut tidak bersesuaian dengan kedudukan kami sebagai hakim di bawah Perlembagaan” dan “oleh itu adalah lebih baik kami bersabar demi kepentingan Negara”.
21. Semua kenyataannya di dalam dua ucapan yang disampaikan jelas mengandungi kecamannya terhadap Perdana Menteri dan Kerajaan, jauh lebih lama sebelum dianya menulis surat kepada YDP Agong.
22. Satu lagi perkara yang dibangkitkan di dalam suratnya kepada YDP Agong ialah “the accusations and comments have brought shame to all of us (judges) and left us mentally disturbed to the extent of being unable to discharge our functions orderly and properly.” [tuduhan-tuduhan dan kenyataan-kenyataan yang dibuat telah memalukan kami dan telah meninggalkan kesan kekacauan mental sehinggakan kami tidak dapat menjalankan tugas kami dengan tertib dan teratur].
23. Di bawah Seksyen 125 Perlembagaan Persekutuan, klausa (3) peruntukan untuk memecat hakim, selain daripada salahlaku termasuk ketidakupayaan tubuh badan atau pemikiran atau lain lain sebab, untuk menjalankan tugas-tugas jawatan dengan saksama.
24. Tun Salleh sendiri mengakui yang beliau tidak terdaya untuk melakukan tugas-tugasnya dengan teratur dan tertib. Oleh itu beliau tidak layak untuk terus menjadi hakim.
25. Seksyen 125, klausa 4 memperuntukkan kuasa YDP Agong melantik Tribunal dan boleh atas nasihat Tribunal menyingkirkan hakim daripada kedudukannya.
26. Kedua-dua surat daripada Tun Salleh dianggap YDP Agong sebagai tidak sesuai dan menghina terutamanya kerana salinannya dihantar kepada Raja-Raja Melayu lain.
27. Di dalam salah satu daripada mesyuarat mingguan saya dengan YDP Agong, baginda telah menyatakan ketidak puasan hatinya terhadap surat-surat tersebut dan telah meminta saya menyingkir Tun Salleh Abas daripada jawtan Ketua Hakim Negara. Baginda telah menulis sendiri permintaan baginda di ruangan tepi (margin) surat pertama Tun Salleh berkenaan dengan bunyi bising daripada kerja-kerja yang sedang dijalankan di kediaman YDP Agong.
28. Bagi YDP Agong ianya adalah perkara mudah. Baginda yang melantik Ketua Hakim dan mempunyai hak untuk menyingkirkan beliau. Saya fikir adalah lebih baik bagi saya merujuk perkara ini ke Kabinet dan nasihat Peguam Negara didapati.
29. Saya mengaku rungutan Tun Salleh terhadap saya di dalam suratnya juga menimbulkan ketidak puasan hati saya. Adalah benar yang saya telah mengkritik hakim-hakim kerana mentafsir undang-undang yang dilulus Kerajaan yang tidak menepati matlamat atau objektif undang-undang itu. Saya ada mencadangkan bahawa jika undang-undang yang ditafsirkan berlainan lain daripada matlamat asal sepertimana yang Kerajaan dan penggubal undang-undang harapkan, maka undang-undang tersebut akan dipinda. Di dalam satu mesyuarat Kabinet saya berseloroh dengan memetik kata-kata Shakespeare, “The first thing we do we hang the lawyers.” (Pertama sekali kita gantung semua peguam). Hanya orang yang dungu sahaja akan mengambil bulat-bulat apa yang saya katakan. Tetapi rupa-rupanya para peguam dan hakim telah merasa tersinggung akan apa yang saya kata dan telah menganggap saya sebagai musuh mereka (yang akan menggantung mereka agaknya!).
30. Saya juga telah mengkritik hakim kerana menggubal undang-undang sendiri menerusi tafsiran mereka dan kemudiannya mengguna tafsiran mereka untuk rujukan. Saya percaya pemisahan kuasa bermakna penggubal undang-undang akan menggubal undang-undang manakala hakim akan menggunapakai undang-undang tersebut. Sudah tentu jika undang-undang digubal melanggar peruntukan perlembagaan, yang merupakan undang-undang tertinggi Negara, maka hakim bolehlah menolaknya.
31. Didapati juga sesetengah hakim menolak membicarakan kes-kes melibat hukuman mati, dan diserah secara tidak adil kepada hakim-hakim lain.
32. Kebanyakan pakar undang-undang berpendapat “It is not wrong for any member of the public or the administration to criticise the judiciary. Justice is not a cloistered virtue.” (Tidak salah bagi sesiapa samada dianya orang awam atau ahli pentadbiran untuk mengkritik kehakiman. Keadilan bukan kesucian yang terkurung) - Peter Aldridge Williams QC
33. Penulis di atas juga telah memetik McKenna J “There is no difference between the judge and the Common Man except that one administers the law and the other endures it” (Tidak ada perbezaan di antara hakim dan orang ramai kecuali yang satu mentadbir undang-undang dan yang satu lagi menerima kesannya).
34. Tetapi Tun Salleh berpendapat bahawa saya cuba menghakis kebebasan kehakiman apabila saya menyatakan pandangan saya bagaimana hakim mengecewakan matlamat asal penggubal undang-undang.
35. Menerusi pelbagai sumber saya dengar akan kemarahan hakim-hakim terhadap saya. Tetapi saya tidak mengambil apa-apa tindakan, jauh sekali untuk menyingkir Tun Salleh. Saya hanya bertindak apabila YDP Agong menyatakan rasa tidak puas hati berkenaan dua surat tersebut.
36. Kabinet bersetuju yang peruntukan perlembagaan haruslah dipatuhi. Oleh itu saya telahpun menasihatkan YDP Agong bahawa Tun Salleh hanya boleh disingkir jika YDP Agong melantik Tribunal untuk mendengar segala rungutan terhadapnya (Tun Salleh) dan membuat cadangan kepada YDP Agong.
37. Selepas YDP Agong bersetuju, Kerajaan memilih enam hakim dan bekas hakim untuk pertimbangan YDP Agong. Ahlinya termasuk hakim Negara asing yang diwakili Yang Arif Hakim K.A.P. Ranasinghe, Ketua Hakim Sri Lanka dan Yang Arif Hakim T.S. Sinnathuray, Hakim Kanan Mahkamah Agong Singapura.
38. Pengerusi tribunal ialah Hakim Besar (Malaya), Tan Sri Dato Abdul Hamid bin Hj Omar. Lain-lain ahli terdiri daripada Dato Sri Lee Hun Hoe, Hakim Besar (Borneo) dan dua orang bekas hakim iaitu Tan Sri Abdul Aziz bin Zain dan Tan Sri Mohd Zahir bin Ismail.
39. Penyertaan hakim asing adalah untuk mempastikan yang tribunal tidak mengambil sikap berat sebelah.
40. Malangnya Tun Salleh Abas enggan hadir di hadapan Tribunal. Sebaliknya dia mengharapkan yang rakan-rakannya akan cuba untuk menghalang keputusan Tribunal daripada disampaikan kepada YDP Agong.
41. Apa yang dilakukan kelima-lima hakim yang bersimpati kepadanya sudah tentu melanggar apa yang Tun Salleh utarakan semasa berucap di majlis pelancaran “Law, Justice and the Judiciary. Transnational Trend” apabila dia berkata; “we as judges must act with responsibility and dignity and not be drawn or tempted into any impulsive action which could only result in aggravating the situation” (kita para hakim mesti bertindak dengan penuh tanggungjawab dan terhormat dan tidak dipengaruhi tindakan gelojoh yang mungkin akan memburukkan lagi keadaan).
42. Kelima-lima hakim tersebut telah mengenepikan peraturan dan prosidur dan keperluan untuk mendapat kelulusan Pemangku Ketua Hakim, disamping menunggu keputusan Hakim Ajaib Singh di atas perkara yang sama. Sebaliknya mereka membatalkan persidangan mahkamah di Kota Bahru yang telah dijadualkan untuk mereka dan telah mngadakan persidangan Mahkamah Agong di Kuala Lumpur untuk mendengar aplikasi Tun Salleh Abbas untuk mengenepikan prosiding bagi menentukan kedudukannya.
43. Lima hakim Mahkamah Agong yang diketuai Tan Sri Wan Sulaiman mendengar aplikasi ex-parte oleh peguam Tun Salleh, berehat seketika, dan kemudiannya kembali dan sebulat suara mengeluarkan arahan menghentikan Tribunal daripada menyerahkan apa-apa cadangan, laporan atau nasihat berkenaan siasatan kepada YDP Agong.
44. Berikutan itu, pemangku Ketua Hakim telah menubuhkan satu panel lima hakim Mahkamah Agong untuk mengenepikan keputusan Mahkamah Wan Suleiman.
45. Saya ingin ulangi yang walaupun Tun Salleh mengkritik saya secara terbuka, saya tidak mengambil sebarang tindakan terhadapnya. Saya hanya berbuat demikian setelah dia menghina YDP Agong dan baginda meminta supaya dianya disingkirkan. Tentulah akan ada yang berkata bahawa saya telah mempengaruhi YDP Agong. Tetapi selama 22 tahun saya tidak pernah melibatkan Raja-Raja di dalam politik atau masalah peribadi. Rekod tertera untuk sesiapa menelitinya.
46. Saya amat mengambil berat terhadap penyingkiran Tun Salleh secara paksa. Saya telah cuba dapatkan Tun Salleh untuk meletak jawatan bagi mengelak sebarang skandal. Pada mulanya dia bersetuju, tetapi telah menarik balik keesokan harinya.
47. Saya telah mendapatkan kelulusan keahlian Tribunal. Saya telah mendapat nasihat Peguam Negara dan pihak lain yang rapat dengan hakim-hakim. Setelah Tribunal ditubuhkan, penglibatan saya berakhir.
48. Apabila Tun Salleh dan hakim-hakim yang lain diberhentikan perkhidmatan mereka, mereka tidak sepatutnya menerima pencen. Tetapi selepas menerima rayuan Peguam Negara, saya bersetuju yang mereka dibayar pencen penuh. Mereka tidak mengalami apa-apa kerugian wang ringgit dan pencen mereka dikira daripada tarikh mereka meninggalkan jawatan.
49. Inilah fakta bekaitan penyingkiran Tun Salleh. Beliau dan rakan-rakan hakimnyalah yang telah membawa penghinaan kepada badan kehakiman.
50. Saya menulis untuk merekodkan peristiwa sebagaimana ianya berlaku. Saya tidak harap pengkritik saya akan berhenti menuduh saya menghancurkan badan kehakiman. Mereka pendakwa saya dan mereka juga adalah hakim saya. Bagi mereka saya tetap Idi Amin Malaysia sebagaimana yang di dakwa Tun Salleh di dalam bukunya “May Day for Justice”. Malangnya ramai yang begitu tersedia mengutuk saya terdiri daripada hakim-hakim.

ReplyDeleteAll the actions and decisions lately of the current government are political to win back support not only from the rakyat but also NGOs, fence sitters and to keep the opposition from harping on the issues.
Pak Lah has lost a lot of credibility and respect in the way he handled the issues. So he just backed down and admit. This is the easiest thing to do. But then, he should know that he was also a party to all the previous decisions because he was in the cabinet.
As for the new law minister, he is just a crowd pleaser with nothing in his agenda but politics and gaining popularity.

ReplyDeleteIt is hard to disagree with you on this, even though i myself was still a toddler at that time, with such a bold statement from you, certainly the pen (or in this case, keyboard) is sharper than words.
Ever since i heard about Tun Salleh Abbas, there hadn't been any clear picture of why he was removed from the office. The worst thing i heard is that he was removed because he saved a girl from being converted to another religion, (which i subsequently almost believe).
This is the first revelation on what actually happened in that time. Your words, the written confession about Tun Salleh Abbas was so convincing, just like your speech. I can always see the honesty in your eyes when you speak, and certainly it translate here to your writings.
Great writing Tun, keep it up. More and more revelation is needed. At least, we can have something to cheer on, during this oil-craze season...

ReplyDeleteKami merasa hairan dengan perlantikan Zaid Ibrahim < Menetri yand terlalu banyak bercakap akan membawa kemusnahan kepada kerajaan, kini kerajaan melalui Menteri Zaid yang bijaksana telah mengaku salah, bolehkah Tun Salleh menyaman kerajaan atas saman wrongful dismissal? Mampukah kerajaan mebayarnya? Kerajaan sudah tiada duit hatta dalam soal beras sekali pun..nak bayar saman berbillion? Mungkin Firma Zaid Ibrahim & Co (yang mana Menteri Zaid claim sudah tiada kepentingan) akan mahu mewakili saman itu?
Mengapa begitu teruk sekali kerajaan kita Tun, Boleh kan Tun lakukan sesuatu? Bolehkan Tun berada di The Loaf pada hari tertentu supaya rakyat biasa seperti kami dapat berjumpa Tun?

i do not think that PKR, DAP, HINDRAF or PAS should be the one to rule if UMNO fails....clearly we can see they are rooting for their own interest....if not why are they keep flaming people to do things that are not appropriate by our culture...
I hate to see Malaysian picketing...hate to see people shouting...hate to see they are not considering how other peoples feels...and hate to see that they are poisoning the youth mind
Hope to see you as the benefactor for the new party...so it won't sway of its objectives....

ReplyDeleteThanks for clearing up the matter. Now, it is possible to comparea and contrast your view and Tun Salleh's view in his book `May Day for Justice'. On the balance of probaility, i agree with you that despite everything you said about the judiciary - and you were justified in doing so, the removal of Tun Salleh was his disrespect to YDPA who appointed him and his admissions that he was mentally disturned. What more, YDPA has the right to remove judges upon the recommendation of the tribunal set up for that purpose. YDPA is the ultimate person in power who appoints PM, Chief Justice, and the Attorney General, not to say Chief of the Armed Forces etc. The Federal Constituion states no other person precedes His Majesty YDPAin Malaysia. I agree with you Tun that the letter by Tun Salleh to YDPA was a disrepect to YDPA, and in that two letters, Tun Salleh himself admitted that he `was mentally disturbed' and `could not discharged his functions properly.' Since Tun Salleh decided not to defend himself over those admission, he deprived himself the oppurtunity to explain what those statements means. Anyway, Tun Salleh was duly removed acccrding to law, and was given his pension out of `mercy'. Now, an additional ex gratia payment for `whose mistake'?

ReplyDeletefirstly, tahniah untuk penjelasan tentang minyak semalam. sy harap tun dapt meneruskan menulis tentang isu semasa dan isu rakyat.
tentang artikel ini pulak, sekarang barulah saya dapat gambaran sebenar tentang apa yang berlaku. sebenarnya setiap kali tun membuat sesuatu keputusan, saya tak pernah meragukannya, sebab tun mesti sudah ada sebab yang logik untuk setiap tindakan walaupun ia mendapat banyak kritik dari orang ramai.
tapi, apa yang saya kesalkan, banyak antara kita selalu membuat penilaian negatif tentang sesuatu perkara sebelum mendengar penjelasan dari kedua-dua belah pihak.
pada pendapat sy, tun selalu membuat penilaian jangka panjang untuk sesuatu perkara sebelum mengambil tindakan. itu yg sy respect sgt dengan tun.
satu lagi tentang tindakn tun mendesak sekeras2nya untuk pak lah meletakkan jawatan sbgai PM. apa yg sy dapat lihat di sini, sokongan terhadap umno sekarang telah semakin kurang apatah lagi selepas kenaikkan harga minyak. dan jika pak lah tidak meletakkan jawatan secepat mungkin dan menunggu sehingga pru13, keyakinan rakyat terhadp umno akan hilang sama sekali, walaupun nanti akan ada pemipin lain yang naik menggantikkan pak lah. confirm, umno akan kalah walaupun tanpa kepimpinan pak lah. so, jk pak lah turun skarang, keadaan umno dapat dipulihkan dan sokongan akan dapat di tingkatkan, dan bila tiba pru 13 nti umno sudah kuat kembali. tapi, dengan syart pemimpin yang mengantikan pak lah tak mewarisi kebodohan dia.

p/s: wa'ima faktor UMNO baru & UMNO lama dijadikan alasan kepada penubuhan suruhanjaya/tibunal diRaja sekalipun rasa-rasanya Wak boleh terima. selagi "kepentingan umum" terbela, Wak tak kesah korbankan "kepentingan peribadi". korbankan satu lebih baik dari korbankan seribu. inilah dilema seorang pemimpin yang harus ada sifat berani untuk membuat keputusan dan berani menanggung akibat dari keputusannya tersebut.

Kini Pak Lah nak nayakan Tun dalam hal ni...dia silap besaq la...
malaysia-today oleh RPK pernah satu masa dulu menulis berkenaan surat komplen oleh Tun Salleh yang dihantar kepada DYMM Agung ketika itu tapi kebanyakan orang pikir alasan itu tak cukup dramatik. Tapi setelah membaca penjelasan dari Tun sendiri saya yakin Tun sudah banyak difitnah dan diburukkan bagi memuaskan hati agenda politik mereka yang kurang pengetahun.

ReplyDeleteBut judges led a lonely life, having to shun public eye and not fall into temptation. They have to be understood from a very wide perspective. As their lives have great impact and they themselves are human too.
I believe you Tun tried to protect their good image in carrying out your duties. Now that the worms are out, the present government should have a proper Royal Commission to investigate what you puported here.
Perhaps it can divert the rakyat woes for a while after their biggest shock in their lives 2 days ago over this number 2.70.

Clearly, the Govt is redressing a grave injustice committed during the tenure of the previous administration led by none other than YOU.
That does not necessarily mean you knowingly or intentionally intended to pervert the course of justice or were responsible for the debacle. After all, a Tribunal was the one which passed sentence. Hindsight is always 20:20!!
This action by the AAB Govt (of which I am not a supporter) is neither without precedent locally, nor Internationally. Justice cannot be time-barred merely due to change of administrations or Govts.
If you have done nothing wrong, why worry about it? Isn't that what you told Anwar, Kit Siang, Karpal etc etc?
Let Justice take its natural course.
Or, are you suggesting that Justice can only prevail under your personal administration?

ReplyDeleteI for one believe that judges are no angels and they are also human. They have their own egoes and sometimes they act in manners that does not reflect a judge's stature.
There are however judges that are really professional and their conduct is of the highest dignity and stature.
The rule of law should always be upheld in whatever case be it against judges or even the Lord President.
I fully support the decision made by the government then but i really dont understand why the present government have to do something stupid like paying ex-gratia payment. It is clear this was done to get the support of the BAR Council and people and to gain popularity.
Zaid Ibrahim wants popularity and support but even his own State doesn't want him. He is not popular at all in Kelantan. But with PM being blinded by something, he appointed a minister from a state that BN lost all seats. He should at least have considered someone from Sabah or Sarawak as minister. Doesn't Sabah or Sarawak have capable candidates?
PM knows that the BAR Council is against the government and what better way then to gracefully give something to gain the support of the BAR Council. Give another 6 months, PM will repeal the ISA, then you'll have chaos.
To me the main agenda is to get to Tun personally and gain popularity. I pity the people of malaysia including myself for having a pathetic prime minister that will lead us to nowhere.
Salleh Abas shouldn't have been paid a single cent and no apology should have been offered.
Thank you Tun for enlightening us on the Salleh Abas case.

Walaupun Tun menulis dengan penuh keiklasan dan berfakta tetapi anasir-anasir yang selalu mencemuh Tun tetap tidak akan mempercayai fakta-fakta tersebut. Mereka akan terus mengunakan 1,001 macam cara dan andaian untuk memperlekehkan fakta-fakta yang diberi oleh Tun.
Tapi bagi majoriti rakyat Malaysia termasuk saya mempercayai kepada ketulinan dan ketulusan maklumat yang Tun nyatakan disini.

ReplyDeleteI visit your blog almost everyday to get the latest 'fruits' of your mind. I used to ignore the political situations in our country until recently when Pak Lah came into the scene. I represent a part of the younger generations (early 20s) who is still struggling to find my own identity and place to settle in. However, recently (especially after the election) I have to worry about another thing - what Pak Lah did to Malaysia.
I was in Langkawi when I heard about the rising of oil price and I had seen how the people act towards it. It was a very sad situation but i really think that Malaysian people are very kind and kind enough to be patient with such news. I was wondering if this is Indonesia or some other poor countries, the petrol stations would be burnt down and chaos everywhere. Where is my lovely and harmony Malaysia?...that will be one of my questions if it happens. Really hopes that I wouldn't have to ask that question to myself.
My knowledge on politics and history is very poor but I do know who can I trust to run this country so that I could do my job, which is to prepare myself for the future of this country. What Pak Lah has done to our country is really really sad. Now I can't see my future or the country's future in his hand. But, again, I remind myself that life is like a wheel, there is a moment when we're on top, next thing we are down to earth.
And now the thing about Tun Salleh......I have nothing more to say Tun. I am speechless of what that 'man' (Pak Lah) has done to my Malaysia. What will be left for us when we, the younger generation, take over the nation???....
Lastly, keep on writing Tun. Your words keep us alive....

I thought "Santa Claus" will only appear during Christmas. But how come he appeared during middle of the year.I wonder what really is the value of the "special gifts" presented to these special people.
Some people are very "lucky" indeed!
But unfortunately, the sledge he was travelling to deliver the "gifts" met an accident. Incidentally, it seems that some of them decline to receive the gifts for some reason best known to them.

ReplyDeleteSelepas 20 tahun baru lah Tun menceritakan apa yang sebenarnya berlaku. Peritiwa ni berlaku masa umur saya 15 tahun tingkatan 3. Masa tu tak faham ape2 pun pasal hal2 negara. Yang kita tahu ramai orang cakap Tun memerintah secara kejam. Pecat hakim la, operasi lalang lah.
So hari ni baru saya faham. Sebelum ni yang saya faham kuasa untuk lantik/pecat ketua hakim adalah hak YDP Agong. Tu yang dok fikir, mcm mane lak boleh orang cakap Tun yang pecat.
Sekarang ni Lim Kit Sing dok melalak kat Parlimen kata Tun yang pecat Salleh Abas. Lim Kit Siang tu nama je Ahli Parlimen tapi mcm orang bodoh. Agak2 Tun, boleh tak kita charge Lim Kit Siang kat mahkamah sebab hina YDP Agong atas kes Salleh Abas ni? Saya bukan faham sangat hal-hal legal ni.
Satu lagi kes yang kerajaan bayar ex-gratia. Boleh tak kita charge depa-depa ni sebagai menghina keputusan tribunal yang dilantik oleh YDP Agong. Sebab nya mempersenda-sendakan keputusan tribunal yg meghakimi Salleh Abas.
Salleh ni satu hal gak, dia hakim pun tak faham ke? kalau dia dah kena panggil ke tribunal, yg dia tak pergi kenapa? Dia hakim pun tak faham gak ke?. macam mane nk jadi hakim kalau mcm ni. Patut la dia kata dlm surat ke YDP Agong dia tidak dapat menjalankan tugas dgn baik disebabkan ada gangguan.
hahahaha... mari kita gelak kan depa. After 20 year baru Tun bukak mulut. Kalau berani charge la Tun yg pecat Salleh. Patut la depa diam je Tun. Buat keje tak check dulu hujung pangkal.

ReplyDeleteAda suara2 yang mengatakan pendapatan kerajaan hasil daripada keuntungan syarikat petronas telah banyak diggunakan di era tun manjadi PM dan perbelanjaan yang dibuat oleh tun didalam membangunkan malaysia menyebabkan wang petronas bernilai "negetif" dengan erti kata lain komitmen perbelanjaan melibihi pendapatan yang akhirnya menyebabkan keberhutangan yang kritikal.
PM kita yang baru Pak Lah dikatakan mengambilalih kepimpinan disaat kedudukan keewangan negara yang lemah disebabkan keberhutangan yang tinggi.
Justru itu, pak lah mengambil keputusan untuk mengurangkan beban kewangan kerajaan kononnya untuk menyelamatkan kewangan negara yang lama dah terkoyak dengan menghapuskan subsidi.
Dengan penghapusan subsidi ini moga-moga kesannya akan dapat dirasai dan dikongsi bersama oleh rakyat jelata dan merupakan suatu balasan keatas kebodohan rakyat yang dahulunya menyokong kepimpinan tertinggi BN.
Pujian juga diberikan kepada Tun kerana telah keluar daripada BN demi menjaga maruah seorang berstatus "TUN" kalau tidak ianya akan turut sama digelar si bodoh.

ReplyDeleteSatu penjelasan panjang lebar mengenai kisah Tun Salleh Abbas, dan terbukti bahawa Tun mempunyai daya ingatan yang sangat tajam.
Penjelasan ini sangat ilmiah, berfakta dan berhemah tinggi. Tiada sesiapa yang dapat menyangkalnya hatta menggunakan apa jua cara.
Saya kira Tun telah berfikir semasak2nya sebelum menulis penjelasan ini. Kerana ini adalah soal maruah di mana pada 1988 terdapat seorang Ketua Hakim secara senyap cuba merosakkan kepercayaan rakyat terhadap Badan Eksekutif yang di ketuai oleh Perdana Menteri.
Percubaan ini boleh di anggap berjaya kerana sebilangan rakyat percaya bahawa pada era pentadbiran Tun, terdapat unsur2 penglibatan Tun dalam Badan Kehakiman.
Dan setelah 20 tahun berlalu, Tun telah dengan penuh sopan menjelaskan perkara yang sebenar. Syabas Tun, kerana berjaya membersihkan nama Tun dengan begitu terhormat sekali.
Inilah perbezaan sebenar seorang intelektual dengan orang2 biasa.
Dan Tun begitu faham akan dosa membuka keaiban sesama saudara Muslim.
Tapi mereka2 yang tergolong dlm golongan IQ biasa2 ini begitu rancak membuka keaiban2 Tun dan ini boleh di katakan fitnah yang sangat bahaya, menjejaskan kredibiliti Tun.
Sangat bernasib baik kerana Tuhan kurniakan Tun usia yang panjang untuk mejelaskan perkara2 yang sebenar yang ramai orang tidak mengetahuinya. Saya yakin, segala persoalan tentang masa lalu Tun pasti akan di jawab dengan bukti2 kerana Tun tidak suka menuduh yang bukan2 tanpa usul periksa.
Saya tau antara sikap Tun yang paling ideal sekali ialah Tun suka membawa buku nota kecil untuk membuat catatan. Saya pasti koleksi buku nota 555 Tun ada banyak beberapa ribu dan itu adalah diari kpd sesuatu perkara dlm hidup Tun.
Hidup Tun penuh dengan fakta2, sebab Tun dari dahulu gemar membaca. Seperti kata guru saya, orang yang banyak ilmu ini umpama ensklopedia bergerak.
Kami sangat bertuah mempunyai seorang negarawan @ cendikiawan @ doktor yang sangat tinggi IQnya, yang pemikirannya jauh melangkaui zamannya.
Tun ini sangat kaya dengan ilmu pengetahuan,di samping kekayaan harta benda yang rasa2nya tidak penting bagi kehidupan ahli2 sufi.
Tapi sangat sedikit pemimpin2 negara mencontohi Tun. Hanya kami rakyat jelata yang dapat memahami tiupan semangat dan pengorbanan Tun.
Oleh itu, saya amat berharap sekali kpd pemimpin2 di atas sana supaya hentikan kritikan terhadap Tun. Sebenarnya apabila mereka ini mengkritik Tun, sebenarnya mereka membuka pekung di dada, kelemahan dan kenaifan untuk berfikir secara matang dan profesional.
Ada banyak contoh orang seperti ini. Zaid Ibrahim, Shahrir Samad, Ismail Sabri Yaacob,dll.
Agak2nya mereka malas membaca,malas mentelaah, malas berfikir. Langsung tidak kreatif, tidak kritis. Memang tiada langsung bakat menjadi pemimpin.
Sekarang mereka terdesak, desperate meraih sokongan rakyat tapi rakyat tahu menilai antara intan dengan kaca.
Saya mengkritik mereka kerana saya tidak menyukai mereka.
Pernyataan ini cukup kerana saya tahu ramai lagi orang sependapat dengan saya.
Ada ramai orang dilahirkan sebagai pemimpin, tetapi pemimpin sejati ialah orang yang berkonsepkan 'Kepimpinan Melalui Teladan'.
Akhirnya saya menyeru kpd semua supaya salah sangka terhadap Tun dihilangkan kerana Tun telah menjelaskan sejelas2nya.
Inilah penjelasan terbaik dan penuh berhemah!

ReplyDeleteWalaupun banyak yang diperkatakan tentang Tun, namun harus di ingat jasa seseorang itu hendaklah sentiasa di hargai. Saya sama sekali tidak pernah ragu dengan pimpinan Tun dahulu. Memang ada salah dah silapnya, namun manusia mana yang tidak ada kesilapannya.
Kepimpian Tun ibarat kain putih yang luas, ramai yang dapat melihat beberapa tompok hitam, tapi malang sekali, yang putih itu kita tidak peduli.
Banyak polisi Tun diwujudkan dengan niat yang baik. Namun apabila sampai kepada perlaksanaannya, saya berpendapat Tun sendiri telah di khianati oleh orang-orang yang dipercayainya.
Tun naif apabila beranggapan, orang yang mendapat kekayaan melalui dasar DEB akan membantu rakyat yang lain (spill over effect), malangnya ramai yang menjadi lebih tamak dan takbur. Apa yang Tun boleh buat.
Setiap jumaat selepas imam masjid menghabiskan doa untuk sultan, saya akan tambah nama Tun dalam nya.

They are really ridiculing the whole judiciary system. My God !! What is happening to the present government under Pak Lah. They are are all "playing the fool" !!
My impression on the new Law Minister is that he is just an impressionist trying to exert his influence as if he is the best, the most respected and successful legal guy in town.
I have my doubt. I think he should just go back to his legal firm and continue his profession as a lawyer.He is wasting his talent by being a Law Minister with no credibility, as far as my perception about him is concerned.

Maka,segala penjelasan dan bukti yang Tun berikan telah memberi kefahaman kepada rakyat dan diucapkan terima kasih.
Oleh itu, seperti gesaan saya yang lepas, lebih elok jika perkara ini dibawa ke mahkamah dan diperdengarkan kepada masyarakat umum.

ReplyDeleteThere are so many people out there whom, along their way up, would take other people as their stepping stone. We all know better there are indeed, and sad to say, a lot of these kinda people among us.
However, what(who) else to step on in the case he is already considered in the highest position and he is falling out of his supports and taking heavy blows left and right? Sure he think he gotta do something in order for him to sit comfortably in this hot seat, right? And this is when his old habit comes to play again, for him naturally.
So he go on putting his thinking cap which most of us think is bigger than his head to fit nowadays. Old proverbs; "don't have such a big head then don't go getting such a big cap". And walla!! he got to thinking, "I will dig up the so-called past mistakes of the so called ex PM in order to maintain my so called popularity. So he go on letting a certain case which he thought is correct, correct; in order for people to think he is unbiased. And not enough with that, he go public on certain judicial mishaps fm the so called ex PM era, so calling it a mistake fm the past and he is correcting it now. All these for what?
We are not a nitwit Tun, we know his so called styles now, but nevertheless, it's such a welcomed effort fm your blog here explaining the real scenario to us who may be less informed on this matter.
What he is doing now in order to remain in power is to pick your so called past mistakes and trying to so called make it right. What he failed to realised is, there are better issues for him to tackle which the rakyat are on their knees begging for attentions, namely; the sky rocketing prices of daily consumer goods, the higher costs of living nowadays.
I refer to one of the comments posted by zeenat on your Oil Prices issue. If i recall correctly, he mentioned...wait till the next GE( on how we gonna show Pak Lah the exit) or something with the means of this. What i can say is, we don't have time till the next GE. By then, whoever that's supposed to get rich would be filthy rich and the coffer would be empty for the next PM to be able to do anything positive, at least not for a short term period. Who will suffer then? They won't, cuz they will be long gone, away counting the monies in the bank. Only us, the golongan rakyat, left to scrape the carbon off the bottom of the kuali they have used to masak kari kepala ikan earlier.
Tun, pls continue to enlighten us no matter what certain quarters may say abt you, things that are real bad. No one can be perfect, mistakes may be made by one, but to me, your good deeds in serving us for those 22 years are hard to be forgotten, pls take good care of your health for we still do need you, especially in the times like now...

Isu tentang hakim ini telah menjadi satu isu yang sering dibangkitkan oleh pihak pembangkang, mereka memainkan isu ini brmula dari detik penyingkiran Dato seri Anwar Ibrahim lagi di mana mereka menganggap mereka tidak mendapat pembelaan sepertimana yang mereka harapkan. Oleh yang demikian maka timbul lah isu kehakiman dari zaman nenek moyang sehinggalah ke hari ini. Orang yang mengenali Tun Dr. Mahathir akan memahami diri Tun ini yang sememangnya akan menjaga periuk nasi menteri-menteri beliau atau kenalan rapat Tun. Adalah amat mustahil bagi seseorang yang bernama Tun Dr. Mahathir menjatuhkan seseorang itu, tambahan pula teman karib Tun atau pun individu yang kurang rapat dengan beliau. Tun Mahathir ini, merupakan seorang yang amat prihatin terhadap teman-temannya. Jika terdapat kesalahan atau sesuatu masalah yang telah dilakukan oleh menteri beliau, Tun Mahathir hanya akan memberi nasihat agar berhenti secara terhormat. Keprihatinan Tun inilah menjadi punca atau penyebab mengapa hari ini kita lihat semua Menteri memusuhi beliau. saya tidak faham akan masalah orang yang tak kenang budi ini, terutama Si mulut celupar iaitu Nazri Aziz (Menteri di jabatan Perdana Menteri) yang tidak sudah-sudah menghentam Tun Dr. Mahathir. Mungkin anda tidak tahu bahawasanya, Tun Dr. Mahathir pada suatu masa dahulu amat menyayangi Dato Seri Anwar Ibrahim sehinggakan Dato Seri Anwar Ibrahim ini telah di angkat menjadi Timbalan beliau daripada tidak ada sebarang pangkat. Masakan seorang bapa yang menyanyangi anaknya boleh buang anaknya begitu sahaja?. Seorang bapa akan selalu mengambil tindakan terhadap anaknya jika anaknya melakukan kesalahan, akan tetapi jika anaknya masih degil maka tindakan akan di ambil agar anaknya menjadi seorang manusia yang berguna. Adakah ini menjadi kesalahan pada si bapa?. Tidak perlu saya mengulas panjang, bagi yang memahami diri Tun Dr. Mahathir, mereka akan faham akan permasalahan yang dihadapi oleh Tun. Bukan saya menegakkan benang yang basar, tetapi bila kita bercakap tentang kebenaran, maka jangan kita putarbelitkan kebenaran itu. Tun Dr. Mahathir juga seorang manusia dan bukan malaikat, dia juga membuat kesilapan, tetapi Tun sendiri mengakuinya dan perbetulkan keadaan. ReplyDeleteSyukur Alhamdulillah sebab baru sekarang saya dan mungkin orang luar sana benar-benar faham akan cerita sebenar mengenai Tun Salleh Abbas. Tapi sudah tentu Tun Salleh Abbas & The Geng akan mengutarakan hujah-hujah mereka untuk menegahkan benang yang dah basah ataupun memutarbelitkan fakta. Harap Pak Det bersedia ya.
Selain itu mohon kepada Pemimpin sekarang perhati dan dengar betul-betul keluhan kami orang awam nie. Saya benar-benar malu mengenai hal kenaikan harga minyak. Nampak sangat Pemimpin dan barisannya sudah hilang kejantanannya. Minggu lepas beriya-iya beri sekatan kepada foreingners tiba-tiba minggu nie dah tak ada apa-apa. Menyampah betul saya dengan Pemimpin dan barisannya.
Mudah-mudahan Pak Det, Pemimpin serta barisannya sediada dapat duduk bersama dan fikir tentang kebaikan untuk rakyat. Rakyat dah tak tentu hala la nie. Kesian kami...huahuahua...

ReplyDeleteWhen the sacking of judges I was still in my school days. But because what the annouce by the government to pay ex-gratia payment to these judges it caught my attention.
In my mind, what happend to these judges that they did than that are so bad that it warrant them to be dispose, and 2nd why must the current pay ex-gratia.. what is their purpose of paying.
Thru what I can find from newspapers & bloggers.. what was highlighted is the incidents of happening (not why they were sack).
There is always the other part of the stories situation. Thank you Tun for telling us and inform us the facts that leads to their disposal.
My personal view... judges who start to think themselves as high & mighty would like to act as if that he must be respected. Fact that you (judges) does not means you are wiser or better than any other person. They (judges) may know more about the law but are they any street wiser than the rakyat biasa.
Also, I certainly believe Tun you alone cannot and would not be able to remove those judges. It would have been a group decision and with concent from the Agong.
Why current pay ex-gratia to them... Zaid has become the latest YESMAN and who recommends them (judges) to be paid - a lawyer. Does it look that obvious.
Here we are battling with our economic with the hike in prices, judges got portion of the subsidy removed from the rakyat. Who deicdes to give.... BN...
My apology if I sounded rude, but I'm frustrated... there goes part of the petrol subsidy.

Setelah 20 tahun, baru puas saya setelah mengetahui hal sebenar berkaitan cerita 'tun Salleh abas" ini. Pada saya tun di landasan yang benar untuk menerangkan kebenaran sekarang ini dalam pada masyarakat Malaysia dan juga sebahagian masyarakat antarabangsa tidak mengetahui akan kebenaran kisah tersebut.
ReplyDeleteSaya kehairanan kanapalah Pak Lah bersetuju nak membayar ex-gratia tersebut, walhal sikap para hakim tersebut sememangnya tidak betul. Menulis surat mengadu kpd Agong sebab bising pada saya ialah perbuatan biadap.
Pada saya wajar wang ex-gratia itu ditarik semula sebabnya mereka sudah pun dibayar pencen. Kenapa perlu kita memberi wang kepada orang yang berbuat tidak baik kepada negara bangsa kita?

I've been pretty disgusted on how all of these issues were and are told and retold in distorted ways. The Ex-Gratia.. a wastage tax money that could support the 10 A's doing their medical studies instead of 'political move' of 'judiciary bribe' to the judges. The current goverment are giving false hope to the rakyat on 'independencies of judiciaries'.
Walhal inilah mainan 'politik wang' yang cuba membeli kepercayaan komuniti 'kehakiman dan undang-undang', dan inilah rasuah paling buruk yang saya dapat lihat!
Tun, Saya merasakan Tun ada lah seorang yang murni akhlak nya. Saya merasakan begitu sebab Tun menutup rahsia rahsia musuh Tun.Tun hanya mendedahkannya kerana hanya terpaksa.

Saya mencadangkan agar ada kerajaan baru dan Tun menjadi penasihat kepada kerajaan, sama seperti Lee Kuan Yew. Dengan adanya Tun semula dalam kabinet , Malaysia boleh kembali gah di medan antarabangsa.

Atau jika mereka menubuhkan juga suruhanjaya ini utk "mengenakan" TUN akan turut juga mengheret sama YDP Agong pada masa itu? Jadi jalan mudahnya adalah bayaran ex-gratia.

ReplyDeleteI wish Zaid Ibrahim would respond to this. I really wanted to hear the reason why he took money from tax payers to give to someone who was found guilty through a lawful process.
I, as a tax payer, do not agree to give money like this unless we are informed in detail of the reason why?
There is no transparency in this payment and if this is the type of changes government want to introduce, we disagree.

ReplyDeleteIn the name of good governance and transparency, I think it is only logical for Pak Lah's government to withdraw IMMEDIATELY the payment of ex-gratia to the ex-judges. They have no right at all to enjoy the ex-gratia payment. Only a fool will agree to such payment after knowing the true background why they were sacked.
Now I just want to hear Pak Lah's or Zaid's reaction to this exposure of the truth made by you, Tun. What "cock and bull story" they will tell the rakyat to substantiate their decision to award such payment to the ex-judges. Morally, it is very clear indication that the govt. is totally WRONG, period.

ReplyDeleteSaya terpanggil untuk memberi komen setelah membaca komen seseorang tadi. Sememangnya kita perlukan sebuah parti baru. Saya hanya rakyat biasa yang marah dengan UMNO pada era ini dan saya tidak ada pilihan untuk dipangkah dalam PRU.
Kemarahan terhadap UMNO menyebabkan kita menanamkan hasrat tidak memilih UMNO dalam pilihanraya, tetapi mengundi mesti mengundi...kerana tanggungjawab kepada negara Hendak tak hendak..parti pembangkang akan di pangkah untuk melepaskan geram (kerana tidak ada pilihan).
Sebenarnya rakyat tidak ada pilihan TUN. Sekiranya ditubuhkan sebuah parti baru untuk orang melayu, sesungguhnya sokongan terhadap parti ini saya kira mesti amat luarbiasa. Parti ini lah yang akan meneruskan perjuangan orang Melayu dan membela nasib orang Melayu.
Pada pendapat saya ..UMNO sudah rosak disebabkan Pak Lah and the gang. Seperti kata orang-orang tua..seperti tikus yang kononnya berhasrat nak baiki labu. Dah tak guna labu tuh..dah ditebuk sana sini. Tidak bertambah baik labu tuh..hanya menanti keadaan hancur di telan bumi.
Jadi..tak salah rasanya kita dapatkan sebuah labu yang elok dan masih baru....hehe!

Tun Dr Mahathir Mohamad, setelah membaca pos ini, dapatlah saya mengetahui kebenaran perihal pemecatan Salleh Abbas. Saya juga faham betapa Tun Dr Mahathir Mohamad menyimpan bukti, lalu bersabar, dengan terus mendiam diri, selama ini, sehinggalah pos ini diterbitkan di blog ini, tadi. Tun Dr Mahathir Mohamad, bijak berpendirian demikian, walaupun tuduhan, kritikan, penghinaan, kata nesta dilemparkan kepada Tun Dr Mahathir Mohamad, oleh mereka yang memihak kepada Salleh Abbas, sedangkan mereka tidak tahu hakikat sebenarnya, lantaran ikut sedap mulut sahaja. Jelaslah sekarang siapakah orang yang sebenarnya mencemar duli Tuanku Raja, khususnya DYMM Seri Paduka Baginda Yang DiPertuan Agong. *Kisah Tun Salleh* ini, turut mendedahkan satu lagi kesilapan Abdullah Ahmad Badawi dari sudut kepemimpinannya. Abdullah Ahmad Badawi pemimpin yang lemah. Barangkali Abdullah Ahmad Badawi belum menyedari UMNO sekarang bukanlah lagi UMNO yang seperti dulu. Abdullah Ahmad Badawi tidak menyedari melantik individu yang kelihatan UMNO namun setiap masing-masing ada agenda tersendiri, khususnya usaha mensabitkan ataupun memalukan Tun Dr Mahathir Mohamad di waktu kini. Individu seperti ini kelihatan bersih di bawah naugan perundangan negara, dan setelah menyertai kabinet, telah mengambil peluang pula, untuk menggunakan Abdullah Ahmad Badawi, supaya hentaman dilakukan ke atas Tun Dr Mahathir Mohamad. Abdullah Ahmad Badawi tidak sampai kepada kebijaksanaan ini, dan bila dicadangkan membayar ex-gratia kepada Salleh Abbas, Abdullah Ahmad Badawi telah pun bersetuju. Mungkin perihal Malaysia kehilangan Batu Putih kepada Singapura belum lagi menjadi pelajaran berguna untuk menyedarikan Abdullah Ahmad Badawi. Akan betapa pentingnya surat dibaca dan disimpan teliti, sifat ini ada pada Tun Dr Mahathir Mohamad yang masih boleh mengadakan tiga surat berkaitan dengan tarikh yang boleh dirujuk sebagai bukti. Malang sekali jika pemimpin yang duduk di kerusi Perdana Menteri sekarang, tidak membaca surat yang diterimanya, mahu pun tidak menyimpan rapi surat yang telah diunjukkan kepadanya, barangkali usah lah merasa hairan jika ada orang tua dari jauh datang ke pejabat kerajaan di Putrajaya, lalu ada kakitangan yang dengan sombong memberitahu, "Surat Pak Chik dah hilang, kami tak tahu mana letak failnya, jadi pergi balik ke Ijok dulu, tunggu kami telefon balik 6 bulan lagi, jika surat itu kami jumpa", mithalnya. Jika Abdullah Ahmad Badawi merasa menang kerana berita semalam bayaran ex-gratia itu telahpun dilangsaikan, bersama dua nama lagi Salleh Abbas dan barangkali Zaid Ibrahim juga, serta barangkali ada lagi yang turut bersangkutan di kedudukan pujian. Namun, dengan pos ini, sekali lagi Abdullah Ahmad Badawi tewas di pandangan mata sebahagian rakyat. Jika Abdullah Ahmad Badawi tidak meletakkan jawatan sekarang, dan dia mahu terus lagi duduk dikerusinya kini, dan jika dilayani kesumat di hatinya, dan barangkali mahu pula mengguna isi daripada barangkali 6 kotak, yang boleh digunakan untuk menhentam Tun Dr Mahathir Mohamad lagi, apakah Abdullah Ahmad Badawi sanggup masuk terperangkap sekali lagi, kerana UMNO sekarang dipenuhi pelbagai orang UMNO yang masih tebal latar ikatan kepartiannya kepada yang asal selain UMNO. Setakat ini, ada yang masih boleh lagi membariskan Abdullah Ahmad Badawi bersama empat pemimpin yang lalu. Rakyat Malaysia ni baik-baik belaka. Namun, jikalau rakyat jelata di kalangan anak muda pun, dan mak chik pun, dan lain-lain lagi, sudah saban minit mencercanya sebagai pemimpin yang paling hina, kelak, orang kemudian hari bakal lupa, kecuali mengingati Abdullah Ahmad Badawi sebagai pemimpin paling teruk dalam sejarah kepemimpinan negara.

Saya akui tidak ada manusia didunia ini sempurna 100%, tapi bagi pandangan saya cara pemerintahan Tun merupakan antara cara pemerintahan yang paling effektif didunia sekarang ini, jika dilihat kepada cabran cabaran yang dihadapati semasa pemerintahan Tun ianya adalah lebih dahsyat dibandingkan sekarang, semasa zaman pemerintahan Tun, Malaysi telah menghadapi 2 kali masalah kegawatan ekonomi, dan saya ingin mengucapakan terima kasih yang tidak terhingga kepada Tun yang telah dapat memastikan bahawa rakyat Malaysia tidak merana..jika dilihat pada tahun 1997 ketika kita menghadapai masalah kegawatan ekonomi yang ke 2 tun telah mengambil langkah berani dengan mengikat nilai duit kita dan ini telah menyebabkan rakyat di Malaysia tidak merana.. Di dalam sudut hati saya adalah semasa Tun menjadi perdana menteri dahulu keikhlasan Tun adalah tinggi dan Tun tidak mempunyai apa apa kepentingan, cara pemerintahan sekarang oleh paklah adalah berbeza sama sekali kerana pada pendapat saya pak lah mempunyai kepentingan peribadi...setiap kali saya membaca articles Tun saya pasti akan menitiskan air mata dengan komen komen oleh para pembaca blog Tun.. Harapan saya adalah Tun dapat menyumbangkan idea dan teguran kepada kerjaan walaupun pada hakikatnya kerajaan sekarang tidak mendengar teguran dan nasihat ayahanda Tun tetapi biarlah rakyat menilai sendiri benda tersut adalah diharapakan Tun berada dalam keadaan sihat dan dipanjangkan umur...harapan saya adalah agar kita dapat berjumpa kerana saya ingin membincangkan tentang pelbagai topik untuk kepentingan anak dan cucu saya di masa depan

Berdasarkan fakta TDM ini jelas Tun Salleh sudah diberikan pampasan yang sewajarnya sebagai kakitangan kerajaan. Dan berdasdar fakta TDM ini jelas dia telah dipecat menurut undang-undang yang telah dipersetujui bersama.

ReplyDeleteHaving read the morning paper regarding ex-gratia payment to judges, nostalgic feelings pour inside me. I remembered that incident well as if it was yesterday. I was in form 6 at that material time and was furious at the action taken by the government toward high court judges. I felt that the judiciary was being oppressed by the legislative and felt it was injustice (without knowing the true meaning of justice at the time...). Without a doubt that particular year jump start my intention of becoming a practitioner of law so as to uphold the law. Hence changed my future intention of becoming a professional chef, taking a spin becoming a lawyer instead.
I did not bother to properly read on facts of the matter but merely based on what is printed out in the newspaper and what is shown in tv. I felt that the PM (at the material time) was using excuses to slash the LP in order to ensure everything goes to what the government wants in law.
After graduating that feeling maintained and continously proceed to practise (with pride) to uphold the laws of the country whenever I am in Court (be it Lower Court or the High Court). After few years of practising with maturity, having read today's newspaper, I realised after going through legal practise in maturity and asked myself "do we really need to fork out ex-gratia payment to these judges after all these years? Why now? Why not issue it much earlier? Is it political gain and popularity purpose so as the opposition will show respect toward the government despite the oil price increased?"
What transpired at that material time was done accordingly to the constitutional law, tribunal was set up to hear the matter yet the accused LP failed in apppearence to defence against allegation made towards him. I asked myself again now "Do we blame the government then for using the legislative power via constitutional law against the judiciary? Who is to be taken as scape goat and be blamed for all that had happen?"
I've read Tun's explanation in details on this point and read further other learned Bloggers herein with their views/comment... Was it necessary to issue that payment? Will that payment create justice and shows the world that the present government is concious and sympathetic thus gain popularity, thus, be compared with the previous government?
Isn't it wise if that monies are channel toward useful needs for the Malaysians rather than these judges who still get their pensions? We can imagine and deduce the High Court judges' salary let alone Lord President's salary wise and other facilities which benefited them let alone getting pension after retirement, yet the present government decided to grant them ex-gratia payment... despite the Malaysian society at large is facing with current situation (petrol price increased) and waiting anxiously to be bombarded with more shocking news...

ReplyDeleteSaya dari dulu lagi sudah hilang keyakinan dengan Tun Salleh ni iaitu sejak dia menjadi peguam bela kepada Mohamad sabu dalam kes khalwat di Kota Bharu awal 1990-an dulu. Pada saya, yang cetek ilmu undang-undang ni..kalau lelaki dan perempuan (kedua-duanya bukan pasangan muhrim) berada berdua-duaan dalam bilik (Bilik 121 Hotel Perdana, Kota Bharu), itu sudah boleh diklasifikasikan sebagai mendatangkan syak dan boleh dituduh sebagai berkhalwat. Cuba bayangkan, lelaki dan perempuan bukan muhrim duduk dalam bilik hotel, tanpa ada orang ketiga, keempat atau kelima (yang ada hanya 'makhluk ketiga' iaitu setan). Lalu Mohamad Sabu ditangkap dan charge sebagai khalwat. Maka dia pun dihadapkan ke Mahkamah Tinggi Syariah Kota Bharu. Malangnya, Tun Salleh Abas yang ketika itu menjadi orang kuat Parti Melayu Semangat 46 telah dengan rela hati menjadi peguam bela kepada mohamad sabu bagi kes khalwat. Pada saya, pasangan yang dituduh khalwat tak perlu kepada peguam bela. Nak bela apa lagi? Dah sah duduk dalam bilik berdua-duaan sampai satu jam, bukan satu minit. Itu khalwatlah. Tapi Tun Salleh yang dada dan otaknya penuh dengan ilmu undang-undang (sivil dan syariah) boleh menawarkan diri jadi peguam bela. Akhirnya Mat Sabu dan Puan Norma dibebaskan daripada tuduhan khalwat. Tetapi kes pasangan remaja yang ditangkap 'khalwat' ketika bersama pasangannya di rumah keluarga perempuan itu (yang ada di rumah berkenaan ialah mak ayah, adik beradik dan kakak perempuan itu) tidak dibebaskan, sebaliknya dikenakan denda RM1,200 tiap seorang. Berkhalwatkah pasangan itu di depan mak ayah dan adik beradik pasangannya? Macamana mereka berkhalwat di rumah yang dipenuhi ahli keluarga? heran juga. Tapi Tun Salleh tak menawarkan diri untuk jadi peguam bela pun. Kerana itulah saya tidak lagi menaruh keyakinan kepada Tun salleh. Harap maaf Tun (Salleh).

Hari ini dilapurkan Menteri Zaid kemalangan jalanraya sewaktu beria2 menjadi posmen Abdullah ketika menghantar bayaran ex-gratia kepada ketiga3 hakim yang mengaku mentally ill itu. Persoalannya, mengapa terburu2 hendak bayar, mengapa hantar sendiri (nak dapat publisiti murah sebagai hero hakim atau nak pastikan hakim tu bayar komisyen kot???), mengapa tak dedahkan jumlah wang rakyat utk bayaran haram ini, mengapa tak tunggu Tribunal Baru untuk membuat keputusan 'kesilapan' konon pemecatan itu.
Abdullah sendiri menghukum 'gantung' Zaid dari jawatan ketua bahagian UMNO selama 2 tahun atas sebab rasuah wang politik sedangkan Zaid tidak pernah mengaku salah. Apabila BN kalah teruk, Abdullah melantik beberapa calon yang kalah teruk atau tidak bertanding dalam PRU12 sebagai menteri, termasuk Mashitah Ibrahim, Zaid Ibrahim dan Shahrizat tetapi gagal melantik ahli2 parlimen Sabah Sarawak yang menyelamatkan Abdul lah.
Mr 'Clean' sheet (disebut shit) melantik Mr 'Corrupt' dumb lawyer yang tidak dipilih rakyat untuk membayar exgratia duit rakyat kepada Mr 'Mentally ill' judge yang menghina DYMM Agong.

If I was Tun Salleh I would have politely turned down the offer of money. I would have held my head up high! Especially when I was receiving the full pension all along.

Unlike some (or most politician - like DSAI) their knee jerk reaction to the opinions that they do not agree - they will sue. Of course as a protege of LKY, what do you expect. They use legal means to stifle opposition!
I would like to draw your attention to the falsehood that they are spreading about you and your family on your opponents websites - claiming the vast amount of money deposited with the "Isreali National Bank" in Singapore. Googled for the bank - NO SUCH BANK IN SINGAPORE OR ISREAL BY THAT NAME!!!! I would expect that at least your critics should be at least "smart" in their lies - proves that they are brainless - at least idiots have brains!!!

Tun, You ought to have published this long ago. When the judges were removed in 1988, I only knew what was in the public domain and was completely taken in by the lies of the interested parties to the extent of wearing a black arm band to mourn the so called "black day of the judiciary".

In the minds of the majority of Malaysians, there was no doubt at all that you, as the PM then , had committed grave injustice to the judges who were sacked. You have always been, and still is, vindictive and vicious. Please do not justify your unwarranted and unjust action now by talking nonsense. Every right-thinking Malaysian as well as the international community of learned law-makers and judges clearly know your wrong-doing. We cannot digest what you are trying to say now. I am not surprised at all (are you all?), as our dear Tun Dr Mahathir has most (if not all) the answers ready, waiting to be unleashed when the time is right. A lot of Tun's detractors will tend to under-estimate him, in spite of the numerous surprises he has sprung. They are all like small kids (in spite of advanced ages) who don't really know who they are dealing with.
I believe many will look forward to further 'surprises' from Tun.

sebab dia tau yang dia memang dah buat salah pada YDP Agong dan dia takkan menang kalau dia cuba mengheret Tun Dr. Mahathir ke mahkamah masa dulu maupun sekarang..
Jika Tun Salleh Abas merasakan pendedahan ini merupakan satu fitnah dan merasakan diri masih lagi teraniaya dengan tindakan pemecatan beliau tersebut, saya cabar Tun Salleh Abbas serta kuncu-kuncunya termasuk Lim Kit Siang dan Majlis Peguam Negara untuk menyaman Tun Dr. Mahathir sekarang!
pak lah memang anti che'det sehinggakan bila pak lah jd pm, semua barang di rumah rasmi pm (termasuk lampu, karpet, perabot, barangan elektrik dan lain-lain) dikosongkan dan diganti dengan barang baru.. sampai macam tu sekali benci dia kat che'det agaknya.. saya buleh paham kalau dia suruh tukar katil tp takkan la semua nak ditukarnya, siap kena renovate balik semula.. ini bukan fitnah, ini adalah kenyataan!

ReplyDeleteSaya yakin niat pemeimpin kita tidak baik,kerana mereka sepatutnya memberi 'ex-gratia' ini pada Tahun 2004 selepas mereka menang besar dalam PRU 11.
Pemimpin kita terlupa dan alpa kerana khayal dengan kemenangan yang diberi rakyat, sehingga mereka lupa terus pada rakyat selepas itu.
Kini, mereka menerima tamparan yang paling bersejarah pabila kalah teruk dan memalukan didalam PRU 12.Sejarah paling buruk dan memalukan bagi seorang Perdana Menteri.
Mereka pun mencari simpati dan ehsan dengan menunjukan bahawa mereka baik dengan memberi 'ex-gratia' ini.Idea ini pula datang dari seorang menteri yang berideology liberal.
Kenapa beliau tidak menasihati Perdana Menteri untuk memohon ampun dan sembah hurmat pada Yang diPertuan Agong dan Sultan Perlis, kerana kekurang ajaran beliau terhadap baginda baginda berdua didalam perlantikan Menteri Menteri Besar Perlis dan Trengganu?
SEJARAH KITA TIDAK PERNAH ADA SEORANG PERDANA MENTARI PALING KURANG AJAR,HANYA ABDULLAH BADAWI.
Mana lebih penting? Bekas bekas hakim atau Yang diPertuan Agung dan Sultan Perlis yang masih memerintah?

Nampak sangat Pak Lah ni tak ikhlas dan tak berwibawa. Sepatutnya klu dia rasa dia betul, dia kena put all these accusitions to a stop. ReplyDeleteTun, saya adalah seorang pelajar yang belajar di salah sebuah universiti di negara kita ni. Saya bukan dari golongan yang senang. Pinjaman PTPTN pon hanya untuk 4 bulan pertama pengajian kerana universiti terletak dalam kawasan bandar, itu pon selepas saya berjimat n makan sehari sekali n megi kalau lapar. dah abih PTPTN, mintak FAMA (father n moher) la pulak. Saya kesian ng parent saya di mana gaji ayah hanya 500++ dan emak saya surirumah sepenuh masa. apa yang saya nak tekankan ialah kami ini student yang tidak mendapat gaji 'lumayan', dan penaikan harga minyak lebih menekankan kami lebih kepada 'makan megi' seiap hari kerana kami juga memakai kenderaan motosikal unuk berulang alik ke kelas. balik kampung pun, rsnya 4 bulan sekali kerana kampung jauh. seperti mana saya baca sura kabar, sedangkan golongan pertengahan pon merungut akan kenaikan harga minyak, inikan pula bagi saya yang tinggal di luar bandar tetapi belajar di bandar. Berapa ramai pelajar universiti tempaan senasib ng saya. kalau dah makan megi tiap2 mgu sekurang2 nya, macam mana otak kami nak berjalan menerima pembelajaran dengan baik. makanan harian memang dah x terjaga. Saya sudah merasa peritnya kehidupan semacam ini berharap idak akan ada lagi pelajar seperti saya di masa akan datang..
Kenapa wartawan tidak bertanya apa kesan kenaikan minyak pada mahasiswa? kenapa tidak bertanya kepada penduduk pekan kecil di negeri2 yang kurang maju? kenapa tidak bertanya kepada guru sekolah rendah? kepada golongan bergaji 1000+ ini lah yang perlu ditanya kesan kenaikan harga, bukan golongan bergaji 5000++ ke atas. Tindakan PAKLAH sama seperti menabur benih2 benci kepada anak2 pokok yang baru hendak membesar seperi kami ini.
Harap Tun dapat memperjuangkan nasib rakyat yg semakin tersepit ini.
Maaf kalau coretan saya terlalu panjang, tetapi ini lah luahan hati seorang insan rakyat Malaysia..

Its very wrong for PakLah & Co to pay the ex-gratia payment to these corrupted judges.If the PakLah & Co thinks that its was wrong of Tun for sacking them,then they should have paid them once PakLah comes into power and not 5 years later.It is fully clear that this action is only an attenpt to win back support from the people and also to show how "transparent" they are and also to make Tun looks ugly.
In my point of view,Those who insult the King or Rulers should be removed no matter who they are or what post they are holding.And if after insulting the King,our goverment still gave them ex-gratia payments.Where is the respect of our KIng and Rulers.

Pardon my little knowledges compared to yours...there is no absolute separation of power..even in UK,US or France....but as far as ur article in this blog is concerned, i still can't see adequate independency of the 3 bodies..perhaps it's not fair for the constituition to lay down things like 'sebab-sebab lain' since it might lead to abuse of power..personally i think if the phrase 'ketidakupayaan pemikiran' fit in that situation.. i dunt think anybody would be able to hold the position independently since they were subjected to the government.so back to the main question; is the court obliged to interpret statute as meant by the government?
by the way i was like 3 yrs old during that time..so forgive me if i dont get the situation..i do believe in restriction of freedom of speech/expression so it's okay if my entry is not publish

ReplyDeleteRINGKAS, TEPAT DAN PADAT... akhirnya setelah meneliti kedua-dua fakta yang dikemukan dan saya membuat perbandingan cerita dengan cerita TDM terbukti punca sebenar pemecatan adalah dari Tun Salleh sendiri...
Moga TDM kalau dapat cetak dalam bentuk pamplet dan edar keseluruh pelusuk negara untuk membersihkan nama TDM... yang semamngnya tindakan Kerajaan... diulangi kerajaan bukan TDM bertepatan dengan prinsip perlembangaan.
Bagi kerajaan PLah sekarang... apa sudah jadi... nampaknya barisan pemikir dan strategis PLah sekali lagi tersilap percaturan... usaha untuk mempopularkan PLah akhirnya memakan diri... samalah dengan bebarapa isu lain sebelum ni yg akhirnya back-fire balik pada Kerajaan...
inilah akibat PLah tak semak fakta dan bukti sebenar dgn teliti asyik dipengaruh oleh budak mentah politik dan penasihat dungu disekelilingnya...
Pemimpin yang sebegini tidak harus dikekalkan kerana membawa kerosakan dan perpecahan serta ketidak stabilan pada negara...

ReplyDeleteThis is a classic example of rule by law rather than rule of law.
ReplyDeleteThe words ‘let us mentally disturbed to the extent’ say only that the accusations could bring such harms to the person concerned, bordering on the inability to functions orderly and properly. The intention was to say that the accusations were harmful, and they should not be repeated. It is not a letter to inform the King that they are at the stage of inability to serve, as to be interpreted as admission of inability. TDM has conveniently taken advantage of the wording in the constitution to equate it with the content of the letter as admission of failure to serve, and TDM seized the opportunity to have Tun Salleh removed. Yes TDM only needed to get the tribunal convened, and the Tribunal can finish the job of removing Tun Salleh for him.
TDM said that the King was angry with Tun Salleh, and wanted him removed. Are we to believe that TDM God-worshipped the King and his wishes were TDM’s command? If that were true, TDM would not have moved against the rulers, and changed the constitution to make the Sultans liable for prosecution on personal conducts. If the King’s anger did not meet with TDM’s secret desire to have Tun Salleh removed, he could have appealed to the King to forgive Tun Salleh for whatever mistakes that Tun Salleh had committed. The King would have certainly accepted the suggestion of the PM. TDM could have advised Tun Salleh to apologize to the king for writing the letter which the King considered to be offensive.
The constitution had the provision to remove judges to prevent injustices that might be committed by judges, in their official capacity. There are not to be removed for personal actions which have no relation to his official functions, such as writing a letter that incurred the displeasure of the King. In fact the King might have said to TDM in jest that he wanted Tun Salleh removed, so that TDM could inform Tun Salleh to make the required amend. But TDM jumped on the opportunity presented by the King to have TDM removed.
Senior government officers might be provided with official cars for their official use. On the way to his office, the officer might take a detour to drop his children at school. That happens for sure and the officer can be charged for corruption if it is so intended. Anwar Ibrahim was charged for corruption and jailed for six years just because he directed investigations on accusation against him. As the DPM of the country, it is in the interest of the government stability that he should do what he did. But according to the court Anwar was said to have acted beyond his authority. Tun Sallh suffered the same fate because a trifling matter was classified as a most serious crime that he had to be dismissed so that law could be upheld. If that was the standard of rule of law, there would not be any minister or government officers left in TDM’s administration.
RPK said in his MalaysiaToday about the letter by Tun Salleh complaining about the noise of construction in the Palace. I thought it was a joke. It is indeed a joke that a letter of complaint could get a Lord President sacked. It gives the impression that the King of Malaysia in 1988 was as fearful as Emperor Yung Zhen of the Ching Dynasty where words can cause the head of the writer. Some 250 years later in a country of constitutional monarchy, letter can cause the career of the head of one of the three branches of government. TDM wants us to believe that he was hapless that he had to act on the wishes of the King, as though if the King had wanted him to prostrate, he could not stand. How convincing.

ReplyDeleteI bought Tun Salleh's book May Day for Justice many years ago and I definitely did not remember Tun Salleh mentioning about the first letter in his book, well apparently he also conveniently forgot to mention it to the five sacked senior judges as well. No matter Tun, when I am at home tonight, I will find the May Day for Justice book and throw it into the dustbin as it is written dengan niat yang tidak ikhlas.
I hope that Zaid who delivered the ex-gratia checks to the sacked judges would read your comments today Tun, does make him seemed dumb and hollow between the ears.
Those Bar Council people, especially the new lady Dato' should be sent email copies also. Abdullah will likely feel like an idiot now for following Zaid's advise (cross my fingers though as like you say Abdullah ini tak reti malu).
Lastly do take care of yourself Tun, your prolific writings in your blog though most enlighthening, informative and thought provoking to the rakyat may require you to take a bit of a rest in between.
I suspect that History will judge you very,very kindly Tun, no matter how much Abdullah and Co try to smear your good name, as history does not lie, so do not worry, everything will be alright in the end as the rakyat will remember you most for the good things that you have done for our great nation.
I agree with you Tun that the letter by Tun Salleh to YDPA was a disrepect to YDPA, and in that two letters, Tun Salleh himself admitted that he `was mentally disturbed' and `could not discharged his functions properly.' Since Tun Salleh decided not to defend himself over those admission, he deprived himself the oppurtunity to explain what those statements means. Anyway, Tun Salleh was duly removed acccrding to law, and was given his pension out of `mercy'. Now, an additional ex gratia payment for `whose mistake'?

So, the conclusion is a disrespect to YDPA is a crime where the perpetrator had to be punished to the end. The person cannot be given a chance to contrite, and the law had to be upheld. There is a pardon board to appeal to the King to show mercy for far more serious matter resulting in capital punishment. Yet lawyer believes that law precedes all consideration, and the accused should be found guilty and punished, and then appeal for pardon could be arranged.
The ACA had held files on 18 sharks, but they are yet no prosecution. Is corruption a more acceptable crime, than words not intentionally meant for insults, but felt by recipient as a disrespect? The disrespect could not have cause hurts that make the recipient not able to function in his official capacity, but corruptions hurt many in different ways. Did the government headed by TDM know not what harms the nation more. TDM must have been in glee having the excuse to remove Tun Salleh.

They don't seem to understand, or comprehend, that they were elected to govern, and serve the interest of the people. What seems to be apparent, is their need to serve only their self-interest, at the expense of the rakyat and the country.
Manipulation of facts, and/or public perception, is done with malice and without conscience. Be it on the matter of the judges, state of the economy, crime or nepotism. Their incoherent actions and arrogance are plainly obvious to us. They, however, do not seem to think that we are paying attention.
I am a product of your administration's vision and policies. You have given us the immense opportunity to discover our true potential, both as individuals, and Malaysians. The country's biggest loss was the day you retired as the PM sir. It is so unfortunate that current leadership and administration is incapable of governing the country, much less leading us.

The Jewish's proxy now have to use Asia especially Malaysia to indirectly attack the Asian economic strengthen...they know that Malaysia is the central deposit investment for Asian Big investors. So, they want to take over the Asian equities through Malaysia in economic global to shut Asian mouth from protesting the Jewish and their chronis...

I suppose someone feels uneasy with your stature at the background and in order to survive, he just has to throw some mud at you. Unfortunately, this also strikes a chord with the opposition parties who, of course, have their own agenda. But, Tun, the truth will prevail.

"Isk..Isk..Isk.. anak-anak aku kena berhenti sekolah sebab aku tak cukup bajet nak antaq depa p skolah, dahlah gaji aku RM800 saja sebulan".
Itulah antara keluhan-keluhan dek keperitan masyarakat Malaysia sekarang di bawah pemerintahan Pak Lah.
UMNO tidak bersalah, sebab ia hanyalah sebuah parti untuk menaikkan kedudukan Melayu.
Tetapi kepimpinan UMNO yang bersalah sebab "amat bodoh" dan "keras kepala". Mungkin sekarang orang sudah hilang kepercayaan kepada UMNO dek kebodohan pemimpin-pemimpinnya.
Buat apa hendak bayar ex-gratia kepada bekas-bekas hakim terbabit. Tidak ada sebab yang kukuh untuk beri ex-gratia kepada mereka.
Tindakan membayar ex-gratia kepada bekas-bekas hakim tersebut menunjukkan kelemahan kerajaan Pak Lah. Selain itu, rakyat akan hilang rasa percaya terhadap ketelusan kerajaan di dalam melaksanakan tindakan dan keputusan.
Pembayaran ex-gratia kepada mereka telah memburukkan nama badan eksekutif. Badan eksekutif yang dikepalai oleh Pak Lah memperlihatkan keburukan sendiri seolah-olah pemberhentian bekas-bekas hakim itu adalah atas dasar "ketidakpuasan hati Perdana Menteri pada masa lalu". Padahal, tindakan memberhentikan mereka adalah kerana keputusan dan tindakan bekas-bekas hakim itu adalah tidak betul dan tidak amanah.
Pembayaran ex-gratia seolah-olah mempertikaikan tindakan kerajaan sebelum ini yang juga dipimpin oleh negarawan terulung yang tiada tandingan, Tun Dr Mahathir.
Pak Lah telah melakukan tindakan yang gopoh dan bodoh di dalam hal ini.
Pak Lah sering membuat keputusan dan tindakan tanpa berfikir dahulu akibatnya dan rasionalnya.
"Woi Pak Lah, baik hang turun cepat, sebelum semua rakyat bersatu menjatuhkan hang".
Semoga Tun panjang umur.
Semoga Tun dan rakyat Malaysia murah rezeki.
Semoga Tun dan keluarga diberi kekuatan untuk melakukan kebaikan.
Semoga Tun dan seluruh rakyat Malaysia diberi kekuatan luar biasa oleh Allah untuk menghadapi pancaroba dan cabaran yang mendatang.

ReplyDeleteSekali lg tindakan kerajaan yg mengecewakan rakyat malaysia...knpa krajaan nk 'reward' tun salleh sedangkan tak dapat apa2 'benefit' pn utk rakyat dan krajaan sendiri? dh tu tak nyatakan pn brapa pampasan yg depa bayaq? tak ka buang duit namanya? sy amat bersetuju dgn tindakan tun pd ms tu, sesiapa pn yg jd YDP Agong akan rs terhina dgn tindakan tun salleh bila dia 'complain' dgn mghantar surat pd semua raja2 melayu yg lain seolah2 dia sengaja ingin memburukkan nama YDP Agong..takkan rs utk mraih sokongan utk krajaan dgn cara mcm 2..?semua rakyat akan trtanya2 knpa krajaan perlu mmberi pampasan kpd tun salleh?ini adalah satu pmbaziran yang akan menyebabkn sokongan rakyat trhadap krajaan akn terhakis. Allah maha besar dan maha mengentahui segalanya,setiap perbuatan yang baik akan dibalas dengan yang baik juga...lambat laun rakyat akan mengatahui siapa sebenarnya....baik TUN,pak lah,salleh abas,zaid yang jadi menteri bukan pilihan rakyat,kj...saya sendiri sudah menilai diri TUN dan pak lah,dalam saya menilai rasahati saya bergitu kasih dan kagum dengan TUN manakala pemimpin sekarang rasahati saya cukup menyampah,meluat dan benci....perasan ini sudah berlaku awal tahun 2005...
Semasa era TUN saya rasa tiada perkara yang sengaja TUN cari salah pemimpin lain,kecuali pemimpin itu sendiri yang mencari kesilapan dan buat hal,itu pun TUN menasihatkan mereka ber-REHAT dan TUN terpaksa mengambil Tindakan sekiranya mereka berkeras tak mahu REHAT...ini membuktikan hati TUN terlalu baik dan tidak hitam.
Saya lihat sekarang,pemimpin lebih banyak cari salah orang lain terutama TUN dari mencari pendapatan negara untuk kesenangan rakyat.....apa motif mereka pun saya tak tahu,bagi saya jasa,sumbangan,idea,pimpinan TUN tiada tolok bandingnya dan tak akan berkurangan walaupun ada usaha-usaha untuk memburukan TUN dan keluarga....rakyat boleh menilai apa yang berlaku...jumpa lagi TUN

I said then and I continue to say that it was like handing over a banana plantation to monkeys to guard. It did not take long for the monkeys to take over did it? You may be right in your explanation here vis a vis theTun Salleh episode and you may be found not at fault and, yes, it was not exactly neighbourly for him to complain about the noise when reovation work was going on. I guess it was even stupid to have sent letters on the complaint to the other rulers. I'd be pissed if my neighbour complained about the noise from my house to any authority anyway.
